84 A RESOLUTION GRANTING A USE PERMIT TO REVEREND WILLIS M. KEARNEY AND MRS. INDIA N. KEARNEY TO OPERATE A GROUP HOME FOR ELDERLY ADULTS AT 1901 PARKER STREET. WHEREAS, Reverend Willis M. Kearney and Mrs. India N. Kearne~have~.made application pursuant to ~40-67 of the Code of the City of Portsmouth, Virginia, as amended, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have dcne all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City Portsmouth, Virginia: (1) That the use for which such use permit is sought: (a) Will not affect the health and safety of persons residing or working in the neighborhood of the proposed use; injurious and (b) Will not be detrimental to to the property or improvements the public use or in the neighborhood; (c) The proposed use is compatible to the abutting residential property; and (d) Will be in accord with the purposes of the Zoning Chapter of the City Code and; (e) The proposed use is consistent with the comprehensive plan. (2) Reverend Willis M. Kearney and Mrs. India N. Kearney are hereby granted a use permit pursuant to ~40-67 of the Code of the City of Portsmouth, Virginia, to operate a group home for elderly adults for seven (7) residents at 1901 Parker Avenue, such property being more particularly described as follows: UP-89-21 BEGINNING at the southeast intersection of Lincoln Street and Parker Avenue; thence east along the south right-of-way of Lincoln Street 65' to a point; thence south 104.5'; thence west 65' to the east right-of-way of Parker Avenue; thence north along said right-of-way 104.5' to the Point of Beginning.
