84 <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO REVEREND WILLIS M. <br />KEARNEY AND MRS. INDIA N. KEARNEY TO OPERATE A GROUP HOME FOR <br />ELDERLY ADULTS AT 1901 PARKER STREET. <br /> <br /> WHEREAS, Reverend Willis M. Kearney and Mrs. India N. <br />Kearne~have~.made application pursuant to ~40-67 of the Code <br />of the City of Portsmouth, Virginia, as amended, for the <br />granting of a use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have <br />dcne all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />Portsmouth, Virginia: <br /> <br />(1) That the use for which such use permit is sought: <br /> <br /> (a) Will not affect the health and safety of <br />persons residing or working in the neighborhood of the <br />proposed use; <br /> <br />injurious <br />and <br /> <br />(b) Will not be detrimental to <br />to the property or improvements <br /> <br />the public use or <br />in the neighborhood; <br /> <br /> (c) The proposed use is compatible to the abutting <br />residential property; and <br /> <br /> (d) Will be in accord with the purposes of the <br />Zoning Chapter of the City Code and; <br /> <br /> (e) The proposed use is consistent with the <br />comprehensive plan. <br /> <br /> (2) Reverend Willis M. Kearney and Mrs. India N. Kearney <br />are hereby granted a use permit pursuant to ~40-67 of the Code <br />of the City of Portsmouth, Virginia, to operate a group home <br />for elderly adults for seven (7) residents at 1901 Parker <br />Avenue, such property being more particularly described as <br />follows: <br /> <br />UP-89-21 <br /> <br /> BEGINNING at the southeast intersection of <br />Lincoln Street and Parker Avenue; thence east <br />along the south right-of-way of Lincoln Street <br />65' to a point; thence south 104.5'; thence west <br />65' to the east right-of-way of Parker Avenue; <br />thence north along said right-of-way 104.5' to <br />the Point of Beginning. <br /> <br /> <br />
