83 <br /> <br />A RESOLUTION GRANTING APPROVAL OF A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, CONSISTING OF THIRTY-ONE <br />APARTMENTS AT 527 HIGH STREET. <br /> <br /> WH~REAS~ Vernon Wimbrough, has made application pursuant <br />to §40-55 of the Code of the City of Portsmouth, Virginia, <br />1988, as amended, for the granting and approval of a group <br />housing project consisting of thirty-one apartments to be <br />developed at 527 High Street, such premises further described <br />as Tax Map 13, Parcel 3, and a portion of Parcel 2, and such <br />group housing project having been designated at GHP-89-8 and <br />consisting of four (4) two (2) bedroom units and twenty-seven <br />(27) one bedroom units in the existing structure at 527 High <br />Street, all units within the existing structure on the <br />property; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of §40-55 of <br />the Code of the City of Portsmouth, Virginia, 1988, as <br />amended, and the Planning Commission has reviewed such <br />application and site plans submitted therewith and has <br />recommended a conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that the <br />approval of a group housing project pursuant to ~40-55 grants <br />only an exemption from certain requirements for residences as <br />stated in said section, and does not constitute a waiver of <br />any other requirement embodied in the Subdivision Ordinance, <br />Zoning Ordinance, Code of the City of Portsmouth, or any other <br />applicable local, state or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any other required permit be issued only upon compliance with <br />the ordinances, laws~ or regulations applicable hereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the certain group housing <br />project described above and described as GHP-89-8, and more <br />specifically described by correspondence from the office of <br />Dan E. Griffin, the applicant's architect, as shown on the <br />plans filed with the appropriate officials of the City of <br />Portsmouth, Virginia, such correspondence and plans being made <br />a part hereof, is hereby granted approval subject to the <br />following terms and conditions: <br /> <br /> (1) A Certificate of Compliance for the final plans must <br />be obtained from the Downtown Design Committee prior to the <br />issuance of building permits. <br /> <br /> (2) Parking will be provided as described in a letter <br />from Dan E., Griffin, dated October 26, 1989, providing for <br />ten (10) parking spaces. <br /> <br /> <br />
