A RESOLUTION GRANTING A USE PERMIT TO THOMAS BENVENUTO FOR THE <br />OPERATION OF A FLEA MARKET AT 3409r3411 GEORGE WASHINGTON <br />HIGHWAY. <br /> <br /> WHEREAS, Thomas Benvenuto has made application pursuant <br />to Section 40-71(b) of the Code of~the City of Portsmouth, <br />Virginia, 1988, for the granting of a use permit as <br />hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have <br />done all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use permit <br />hereinafter-described is sought: <br /> <br /> (a) Will not adversely <br />persons residing or working <br />proposed use; <br /> <br />affect the health and safety of <br />in the neighborhood of the <br /> <br /> (b) Will not be detrimental to the public use or <br />injurious to the property or improvements of the neighborhood; <br />and <br /> <br /> (c) Will be~in~accordance with the purposes of the <br />Zoning Chapter of~the~City Code. <br /> <br /> 2. Thomas Benvenuto is hereby granted a use permit <br />pursuant to Section 40-71(b) of the Code of the City of <br />Portsmouth, Virginia, 1988, for the operation of a flea market <br />on property located at 3409-3411 George Washington Highway and <br />being more particularly described as Tax Map 385, Parcel 3 <br />(UP-89-16). <br /> <br /> 3. This use permit is approved subject to the following <br />conditions: <br /> <br /> (a) Screening shall be provided of the type and in the <br />location specified in Exhibits 1 and 2 of the use permit <br />application, as recommended by the Planning Commission on <br />November 7, 1989, within 45 days of the date of adoption of <br />this resolution; <br /> <br /> <br />
