A RESOLUTION GRANTING A USE PERMIT TO DOSSIE L. HUBBARD TO OPERATE A CHILD DAY CARE CENTER AT 2321 JEFFERSON STREET. WHEREAS, Dossie L. Hubbard has made application pursuant to ~40-75(b) of the Code of the City of Portsmouth, Virginia, 1988~ for the granting of a use permit to operate a child day care center at 2321 Jefferson Street; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the conditional granting of a use permit for the operation of a child day care center. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property and improvements of the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Dossie L. Hubbard is hereby granted a use permit pursuant to ~40-75(b) of the Code of the City of Portsmouth, Virginia, 1988, to operate a child day care center at 2321 Jefferson Street and more particularly described as: BEGINNING at the southeast intersection of Jefferson Street and Nashville Avenue; thence southeasterly along the south right-of-way of Jefferson Street 100' to a point;-thence southwesterly 155' + to a point; thence northwesterly 100' to the ~ast right-of-way of Nashville Avenue; thence northeasterly along said right-of-way line 159.5' to the south right-of-way line of Jefferson Street, the point of beginning. This use permit is approved subject to the following conditions:
