57 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE A UTILITY <br />EASEMENT ON PROPERTY OF THE PORTSMOUTH PORT AND INDUSTRIAL <br />COMMISSION. <br /> <br /> WHEREAS, by agreement dated July 8, 1987, recorded in the <br />Clerk's Office of the Circuit Court of the City of Portsmouth <br />in Deed Book 991, Page 622, the Portsmouth Port and Industrial <br />Commission conveyed a utility easement and a temporary <br />construction easement to the City of Portsmouth; and <br /> <br /> WHEREAS, the Portsmouth Port and Industrial Commission <br />subsequently acquired adjacent property from the Seaboard <br />Coast Line Railroad; and <br /> <br /> WHEREAS, the Portsmouth Port and Industrial Commission <br />has requested that the utility easement be relocated in order <br />to facilitate development of its property; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth deems it <br />to be in the best interest of the City to release the existing <br />utility easement. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Manager be, and he <br />hereby is, authorized to release a utility easement on <br />property of the Portsmouth Port and Industrial Commission as <br />shown on that certain plat entitled "Plat Showing Existing <br />Utility Easement To Be Vacated By City Of Portsmouth", dated <br />June t0, 1987, prepared by the Engineering and Technical <br />Services Department of the City of Portsmouth. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he <br />hereby is, authorized to sign such deed of release and other <br />documents as may be necessary to carry out the intent of this <br />resolution. <br /> <br /> Adopted by. the Council of th~ City of Portsmouth, <br />Virginia, at a meeting held August 22, 1989. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
