AN ORDINANCE CLOSING A PORTION OF HARDING STREET. <br /> <br /> WHEREAS, Hoechst Celanese Corporation has made <br />application to vacate, close and discontinue the hereinafter <br />described portion of Harding Street; and <br /> <br /> WHEREAS, by resolution of this Council adopted December <br />13, 1988, viewers were appointed pursuant to Section 15.1-364, <br />Code of Virginia, 1950, as amended, to view the hereinafter <br />described portion of said street and to report in writing <br />whether in their opinion any, and if any what, inconvenience <br />would result from discontinuing said portion of Harding <br />Street; and <br /> <br /> WHEREAS, the said viewers have reported in writing that <br />in their opinion no inconvenience would result from closing <br />and discontinuing of said street. <br /> <br /> NO%~, THEREFORE, BE IT ORDAINED by the Council of the City <br />of Portsmouth, Virginia, that the hereinafter described <br />portion of Harding Street be closed and vacated as a public <br />street. <br /> <br /> A portion of Harding Avenue being the <br />southern 15 feet of Harding Avenue between <br />Progress Avenue on the east and Mariner Avenue <br />on the west, and thereby reducing the <br />right-of-way of said Harding Avenue from 80 <br />feet to 65 feet. <br /> <br /> BE IT FURTHER ORDAINED that the City of Portsmouth hereby <br />reserves unto itself a perpetual easement, right and privilege <br />to install, operate, maintain and replace sewer mains, sewer <br />drains, sanitary sewers, electric power lines and telephone <br />lines over, under and across the hereinafter described portion <br />of Harding Street. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held March 14, 1989. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
