1989-23 AN ORDINANCE CLOSING A PORTION OF JAMESTOWN AVENUE. WHEREAS, Quarter Century Corporation has made application to vacate, close and discontinue the hereinafter described portion of Jamestown Avenue; and WHEREAS, by resolution of this Council adopted December 13, 1988, viewers were appointed pursuant to Section 15.1-364, Code of Virginia, 1950, as amended, to view the hereinafter described portion of said street and to report in writing whether in their opinion any, and if any what, inconvenience would result from discontinuing said portion of Jamestown Avenue; and WHEREAS, the said viewers have reported in writing that in their opinion no inconvenience would result from closing and discontinuing of said avenue. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that the hereinafter described portion of Jamestown Avenue be closed and vacated as a public avenue. Ail that portion of Jamestown Avenue beginning at a point on the southeast corner of High Street and Jamestown Avenue where they intersect, thence in a southerly direction along the east side of Jamestown Avenue 220 feet more or less to King Street, thence in a westerly direction along the north side of King Street 8 feet to a point, thence in a northerly direction and parallel with the east side of Jamestown Avenue 220 feet more or less to High Street, thence in an easterly direction 8 feet to the point of beginning. BE IT FURTHER ORDAINED that'the City of Portsmouth hereby ~eserves unto itself a perpetual easement, right and privilege to install, operate, maintain and replace sewer mains, sewer drains, sanitary sewers and electric power lines over, under and across the hereinafter described portion of Jamestown Avenue.
