AN ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE CITY OF
<br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 22-1,
<br />22-3(c), 22-5, 22-11(b)(2), 22-13, 22-16(d), 22-77, 22-78(a),
<br />22-123, 22-129(e), 22-132(c), 22-143, 22-171, 22-182(f) AND
<br />(j), 22-215(a), 22-240(b), 22-244, 22-245(a), 22-300(a),
<br />22-346, 22-348(a) AND (b), 22-349(a), 22-395(b) AND (c),
<br />22-398 (5), 22-401(a) AND (b), 22-402, 22-426(d), 22-752(h),
<br />22-754(c)(1), 22-761 AND 22-789(a) THEREOF PERTAINING TO MOTOR
<br />VEHICLES.

<br /> BE IT ORDAINED by the Council of the City of Portsmouth,
<br />Virginia, that Sections 22-1, 22-3(c), 22-5, 22-11(b)(2),
<br />22-13, 22-16(d), 22-77, 22-78(a), 22-123, 22-129(e),
<br />22-t32(c), 22-143, 22-171, 22-182(f), and (j), 22-215(a),
<br />22-240 (b), 22-244, 22-245(a), 22-300(a), 22-346, 22-348 (a)
<br />and (b), 22-349(a), 22-395(b) and (c), 22-398(5), 22-401(a)
<br />and (b), 22-402, 22-426(d), 22-752(h), 22-754(c)(1), 22-761
<br />and 22-789(a) of the Code of the City of Portsmouth, Virginia,
<br />1988, be amended to read as follows:

<br />Sec. 22.1. Definitions.
<br />
<br /> The words and phrases used in this chapter shall, for the
<br />purposes of this chapter, have the meanings respectively
<br />ascribed to them in Section 46.2-100 of the Code of Virginia
<br />as in effect on October 1, 1989, except in those instances
<br />where the context clearly indicates a different meaning.
<br />
<br />Sec. 22-3. Arrest procedure for violators of chapter-
<br /> Generally.
<br />
<br /> (c) Any person refusing to give such written promise to
<br />appear under the provisions of this section shall be taken
<br />immediately by the arresting officer before a magistrate or
<br />other issuing officer having jurisdiction who shall proceed
<br />according to the provisions of Section 46.2-940 of the Code of
<br />Virginia.
<br />
<br />Sec. 22-5. Same- When arrested person to be taken before
<br /> magistrate or other issuing authority.
<br />
<br /> If any person is believed by the arresting officer to
<br />have committed a felony or is believed by the arresting
<br />officer to be likely to disregard a summons issued under
<br />Section 22-3 or refuses to give a written promise to appear
<br />under the provisions of Section 22-3 or Section 46.2-445 of
<br />the Code of Virginia the arresting officer shall take such
<br />person forthwith before a magistrate or other issuing
<br />authority having jurisdiction, who shall determine whether or
<br />not probable cause exists that such person is likely to
