poles shall <br />Formula. <br /> <br /> to make such tests as it shall find necessary to ensure <br /> compliance with the terms of the Franchise and applicable <br /> provisions of local, state and federal law. <br /> <br /> 7.04 Repair of Streets and Property. Any and all <br /> Streets or public property or private property, including <br /> vegetation, which are disturbed or damaged during the <br /> construction, repair, replacement, removal, relocation, <br /> operation, maintenance or reconstruction of the System <br /> shall be promptly repaired by Grantee, at its expense, to a <br /> comparable condition. Any damage caused to the property of <br /> building owners or users or any other person as a result of <br /> any action or omission by Grantee shall be promptly <br /> repaired by Grantee. <br /> <br /> 7.05 Use of Existing Poles. Grantee shall utilize the <br />existing facilities of utilities, whenever practicable. No <br />poles, conduits, or other wire-holding structures shall be <br />erected or installed by Grantee within or upon a City <br />Streeu without prior approval of the City with regard to <br />the location, height, type and other pertinent aspects; <br />such approval not to be unreasonably withheld. City hereby <br />grants to Grantee the right to attach its Facilities to any <br />poles owned by the City. Rental for attachment to City <br /> <br /> not exceed the maximum established by FCC <br /> <br />-16- <br /> <br /> <br />
