AM ORDINANCE CLOSING A PORTION OF COMMERCE STREET AND A FOOT WIDE ALLEY ON THE NORTH AND SOUTH SIDE OF COMMERCE STREET. 10 WHEREAS, the Industrial Development Authority of the of Portsmouth has made application to vacate, close and discontinue the hereinafter-described portion of Commerce Street and adjacent alleys; and City WHEREAS, by resolution adopted by this Council on August 24, 1982, viewers were appointed pursuant to Section 15.1-364, Code of Virginia, 1950, as amended, to view the hereinafter-described portion of said street and to report in writing whether in their opinion any, and if any, what inconvenience would result from discontinuing the below described street; and WHEREAS, the said viewers have reported in writing that in their opinions no inconvenience would result from the closing and discontinuing of said street and alleys. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that the hereinafter-described portion of Commerce Street and the adjacent alley be closed and vacated as a public street and alley. PARCEL I - COMMERCE STREET Ail that portion of Commerce Street which lies between the eastern right-of-way line of Chautauqua Avenue and the western right-of-way line of Virginia Avenue. PARCEL II 10 FOOT ALLEYWAY Ail that certain portion of a 10 foot alley- way running south from the southern right-of-way line of Commerce Street between Chautauqua Avenue and Virginia Avenue for a distance of 400 feet; and all of that certain alleyway running north from the northern right-of-way line of Commerce Streen between Chautauqua Avenue and Virginia Avenue for a distance of 249 feet to the southern terminus of Shea Court. (S-82-9) BE IT FURTHER RESOLVED that the City of Portsmouth reserves unto itself a perpetual easement and right-of-way for the purposes of installation, maintenance and operation of public utility and drainage lines within, over, under and across said hereinabove described street and alley.
