AM ORDINANCE CLOSING A PORTION OF COMMERCE STREET AND A <br />FOOT WIDE ALLEY ON THE NORTH AND SOUTH SIDE OF COMMERCE <br />STREET. <br /> <br />10 <br /> <br /> WHEREAS, the Industrial Development Authority of the <br />of Portsmouth has made application to vacate, close and <br />discontinue the hereinafter-described portion of Commerce <br />Street and adjacent alleys; and <br /> <br />City <br /> <br /> WHEREAS, by resolution adopted by this Council on August <br />24, 1982, viewers were appointed pursuant to Section 15.1-364, <br />Code of Virginia, 1950, as amended, to view the <br />hereinafter-described portion of said street and to report in <br />writing whether in their opinion any, and if any, what <br />inconvenience would result from discontinuing the below <br />described street; and <br /> <br /> WHEREAS, the said viewers have reported in writing that <br />in their opinions no inconvenience would result from the <br />closing and discontinuing of said street and alleys. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br />of Portsmouth, Virginia, that the hereinafter-described <br />portion of Commerce Street and the adjacent alley be closed <br />and vacated as a public street and alley. <br /> <br />PARCEL I - COMMERCE STREET <br /> <br /> Ail that portion of Commerce Street which <br />lies between the eastern right-of-way line of <br />Chautauqua Avenue and the western right-of-way <br />line of Virginia Avenue. <br /> <br />PARCEL II 10 FOOT ALLEYWAY <br /> <br /> Ail that certain portion of a 10 foot alley- <br />way running south from the southern right-of-way <br />line of Commerce Street between Chautauqua Avenue <br />and Virginia Avenue for a distance of 400 feet; <br />and all of that certain alleyway running north <br />from the northern right-of-way line of Commerce <br />Streen between Chautauqua Avenue and Virginia <br />Avenue for a distance of 249 feet to the southern <br />terminus of Shea Court. (S-82-9) <br /> <br /> BE IT FURTHER RESOLVED that the City of Portsmouth <br />reserves unto itself a perpetual easement and right-of-way for <br />the purposes of installation, maintenance and operation of <br />public utility and drainage lines within, over, under and <br />across said hereinabove described street and alley. <br /> <br /> <br />
