(a) Rooms or areas in which smoking is permitted and <br />which are so designated shall be separate to the extent <br />reasonably practicable from those rooms or areas entered by <br />the public in the normal course of use of the particular <br />business or institution; <br /> <br /> (b) In designated smoking areas, ventilation systems and <br />existing physical barriers shall be used when reasonably <br />practicable to minimize the toxic effect of smoking adjacent <br />to non-smoking areas; <br /> <br /> (c) Such designated smoking areas shall not be so large <br />in number or area in any one building that the fundamental <br />purposes of this ordinance are defeated. <br /> <br />Section 24-435. Posting of signs. <br /> <br /> Any person who owns, manaqes or otherwise controls any <br />building or area in which smoking is regulated by this Article <br />shall post in an appropriate place in a clear, conspicuous and <br />sufficient manner "smoking permitted" slqns or "no smoking <br />permitted" signs (or the international "no smoking" symbol <br />consisting of a pictorial representation of a burning <br />cigarette enclosed in a red circle with a red bar across it). <br />Printing on such signs shall be at least one (1) inch in <br />height and the international symbol shall have a circle of at <br />least four (4) inches in diameter. <br /> <br />Section 24-436. Violations and penalties. <br /> <br /> (a) ~t shall be unlawful for any person who owns, <br />manages, operates or otherwise controls the use of any <br />premises subject to the prohibitions or restrictions of this <br />Article to fail to comply with its provisions. <br />Any such person violating any such provision or failing to <br />comply with the requirements of this chapter shall be guilty <br />of a Class 4 misdemeanor. Each day a violation of this <br />Article shall continue constitutes a separate violation; <br /> <br /> (b) It shall be unlawful for any person to smoke in any <br />area prohibited or restricted by the provisions of this <br />Article; provided, however, that no such person shall be <br />deemed to have violated the provisions of this Article unless <br />such person shall have been ~equested to extinguish a lighted <br />or smoldering cigar, cigarette or pipe of any kind and having <br />been so requested failed to do so. Any such person violating <br />any provision or failing to comply with any of the <br />requirements of this Article shall be fined up to twenty-five <br />($25.00) dollars. <br /> <br /> <br />
