(e) Any elementary or secondary school building or <br />childcare facility, whether public or private, in common areas <br />such as classrooms, hallways, auditoriums and public meeting <br />rooms; <br /> <br /> (f) Places of entertainment such as theatres, concert <br />halls, gymnasiums, bowling alleys, auditoriums and enclosed <br />arenas, except smoking in performances as part of the <br />production. Provided, however, that smoking may be permitted <br />in lawfully designated areas pursuant to the provisions of <br />this Article; <br /> <br /> (g) Public restrooms, unless separate facilities are <br />provided for smokers and non-smokers; <br /> <br /> (h) In a designated no smoking area of any restaurant <br />that is subject to the provisions of §24-432 of this Article; <br /> <br /> (i) Any retail store and any food store in which more <br />than four (4) persons are regularly employed at any one time; <br /> <br />(j) Any public meeting. <br /> <br />Section 24-432. Designated no smoking area in restaurant; <br /> <br /> Any restaurant having a seating capacity of fifty (50) or <br />more persons shall have a designated no smoking area <br />sufficient to meet customer demand. Restaurants may not <br />determine that no such demand exists. Restaurants with a <br />seating capacity of less than fifty (50) persons are <br />encouraged, but not required, to designate no smoking areas. <br />Any restaurant required to have a designated no smoking area <br />shall post signs conspicious to ordinary public view at each <br />entrance to the establishment indicating that a no smoking <br />area is available; <br /> <br /> In determining whether a restaurant is subject to the <br />requirements of this section above, the following shall not be <br />included: <br /> <br />(a) Seats in the bar or lounge area of a restaurant; <br /> <br /> (b) Seats in any separate room of a restaurant which is <br />used exclusively for private functions; <br /> <br /> (c) Seats in any room of a restaurant which is closed <br />and not available for seating; <br /> <br /> <br />
