AN ORDINANCE CLOSING A PORTION OF WALDRON AVENUE. WHEREAS, John and Mary Sedberry have made application to vacate, close and discontinue the hereinafter described portion of Waldron Avenue; and WHEREAS, by resolution of this Council adopted September 18, 1990, viewers were appointed pursuant to Section 15.1-364, Code of Virginia, 1950, as amended, to view the hereinafter described portion of said avenue and to report in writing whether in their opinion any, and if any what, inconvenience would result from discontinuing said portion of Waldron Avenue; and WHEREAS, the said viewers have reported in writing that in their opinion no inconvenience would result from closing and discontinuing of said avenue. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that the hereinafter described portion of Waldron Avenue be closed and vacated as a public avenue. Ail that certain piece or parcel of land, lying and being in the City of Portsmouth, Virginia, and being that portion of Waldron Avenue located between an extension of the western side of Bluegill Avenue, formerly First Street (now closed) and the extension of the eastern lot line of Lot 7, Block A, as shown on the plat of Garden Homes, which plat is duly recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake in Map Book 2, at pages 68 and 69. Said portion of Waldron Avenue is approximately 20+ feet wide and 260+ feet long. BE IT FURTHER ORDAINED that the City of Portsmouth hereby reserves unto itself a perpetual easement, right and privilege tb install, operate, maintain and replace sewer mains, sewer drains, sanitary sewers, storm drains, and/or drainage ditches, over, under and across the hereinabove described portion of Waldron Avenue.
