AN ORDINANCE CLOSING A PORTION OF WALDRON AVENUE. <br /> <br /> WHEREAS, John and Mary Sedberry have made application to <br />vacate, close and discontinue the hereinafter described <br />portion of Waldron Avenue; and <br /> <br /> WHEREAS, by resolution of this Council adopted September <br />18, 1990, viewers were appointed pursuant to Section 15.1-364, <br />Code of Virginia, 1950, as amended, to view the hereinafter <br />described portion of said avenue and to report in writing <br />whether in their opinion any, and if any what, inconvenience <br />would result from discontinuing said portion of Waldron <br />Avenue; and <br /> <br /> WHEREAS, the said viewers have reported in writing that <br />in their opinion no inconvenience would result from closing <br />and discontinuing of said avenue. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br />of Portsmouth, Virginia, that the hereinafter described <br />portion of Waldron Avenue be closed and vacated as a public <br />avenue. <br /> <br /> Ail that certain piece or parcel of land, <br /> lying and being in the City of Portsmouth, <br /> Virginia, and being that portion of Waldron <br /> Avenue located between an extension of the <br /> western side of Bluegill Avenue, formerly <br /> First Street (now closed) and the extension <br /> of the eastern lot line of Lot 7, Block A, <br /> as shown on the plat of Garden Homes, which <br /> plat is duly recorded in the Clerk's Office <br /> of the Circuit Court of the City of Chesapeake <br /> in Map Book 2, at pages 68 and 69. Said <br /> portion of Waldron Avenue is approximately <br /> 20+ feet wide and 260+ feet long. <br /> <br /> BE IT FURTHER ORDAINED that the City of Portsmouth hereby <br />reserves unto itself a perpetual easement, right and privilege <br />tb install, operate, maintain and replace sewer mains, sewer <br />drains, sanitary sewers, storm drains, and/or drainage <br />ditches, over, under and across the hereinabove described <br />portion of Waldron Avenue. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held November 27, 1990. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
