AN ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTION 22-395(c) <br />THEREOF, PERTAINING TO RECKLESS DRIVING. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 22-395(~) of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended to read as follows: <br /> <br />Section'22-395. <br /> <br />Same-Penalty for reckless driving under <br />section 22-391, 22-392 or 22-393. <br /> <br /> (c) When any person is convicted of reckless <br />driving as provided in paragraph (10) of section 22-392, <br />in addition to any other penalties provided by law, the <br />driver's ticense of such person may be suspended by the <br />court for a period of not less than sixty (60) days nor <br />more than six (6) months. In case of conviction, the <br />court shall order the surrender of the license to the <br />court where it shall be disposed of in accordance with <br />section 22-347 of this chapter. When the conviction is a <br />second conviction which would require revocation under <br />the provisions of section 46.2-389 of the Code of <br />Virginia, the court shall suspend the driver's license of <br />such person and thereupon transmit the same to the state <br />department'of motor vehicles as provided by law. If such <br />person so convicted has not obtained a license required <br />by chapter 3 of title 46.2 (sections 46.2-300, et seq.) <br />of the Code of Virginia or is a nonresident, such court <br />shall direct in the judgment of conviction that such <br />person shall not drive or operate any motor vehicle in <br />the Commonwealth for a period of not less than sixty (60) <br />days nor more than six (6) months. <br /> <br /> 2. That this ordinance shall take effect on the date of <br />its adoption. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held on November 13, 1990. <br /> <br /> Teste: <br /> <br />City Clerk <br /> <br /> <br />
