Section 33-59. <br /> <br />Resub~ivision with no new improvememts: <br />Procedure. <br /> <br /> The Council of the City o~ Portsmouth has determined that <br />due to the configuration of nonconforming lots and structures <br />on certain parcels of land intended and zoned for residential <br />uses but which were subdivided prior to the enactment of land <br />subdivision ordinances by the City of Portsmouth or Norfolk <br />County, the property owners are unable to develop such areas <br />which in turn hinders overall redevelopment in Portsmouth. <br /> <br /> Therefore, the Planning Commission is hereby authorized <br />to approve resubdivlslon plats covering such property even <br />though the requirements of Article II of this Chapter <br />pertaining to installation of curbs and gutters, street and <br />pavement widening and off-site drainage have not been <br />included. <br /> <br /> An applicant for resubdivision under this section shall <br />prepare and submit a resubdivision plat as provided in this <br />Chapter and shall include a request for approval stating that <br />the resubdivlsion meets the requirements of this Chapter for <br />resubdivision of exempted property. A request made un~er this <br />section shall in all other respects be submitted, processed, <br />reviewed and approved in accordance with this Chapter. <br /> <br /> 5. That Section 33-35 of the Code of the City of <br />Portsmouth, Virginia, 1988, be repealed. <br /> <br /> 6.
