(3) The froJt property line of a flag lot shall not abut the side y~rd of an adjacent lot. (4) The strip of land used for access to the main portion of the flag 10t (the "flagpole" or "panhandle") shall not be included in calculating the area of the lot for the purpose of determining compliance with the dimensional requirements of Chapters 33 or 40 of the City Code, nor shall any part of the "flagpole" or "panhandle" be considered to be the front yard. (5) No more than 10 percent of the lots, in subdivisions which create ten or more lots, may flag lots. be 3. That subsection 33-32 of the Code of the City of Portsmouth, Virginia, 1988, be amended by amending subsection (a)(12) thereof and by adding subsection (j) thereto to read as follows: Section 33-32 Utility and Street Improvements. (a) In subdivisions, or part~ of subdivision, improvements shall be provided as follows: (1) ... (11) (12) Culverts shall be designed in accordance with the Virginia Department of Transportation design standards and details. Endwalls shall be provided as required by, the City Engineer and shall conform to Virginia Department of Transportation standards or City standards. The developer shall provide for soil bearing investigations to determine foundation requirements. Pilings for culvert support shall be provided if needed. Ample waterway shall be provided for in culvert design, based on five (5) year storm recurrence and the drainage area served by the culverts. When requested by the City Engineer, the developer shall provide calculations for major culverts and bridge crossings which shall be based on a 25 year frequency to insure that no flood hazard will result to the public rights-of-way, or to residences or other structures.
