(3) The froJt property line of a flag lot shall not <br />abut the side y~rd of an adjacent lot. <br /> <br />(4) The strip of land used for access to the main <br />portion of the flag 10t (the "flagpole" or <br />"panhandle") shall not be included in calculating <br />the area of the lot for the purpose of determining <br />compliance with the dimensional requirements of <br />Chapters 33 or 40 of the City Code, nor shall any <br />part of the "flagpole" or "panhandle" be considered <br />to be the front yard. <br /> <br />(5) No more than 10 percent of the lots, in <br />subdivisions which create ten or more lots, may <br />flag lots. <br /> <br />be <br /> <br /> 3. That subsection 33-32 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended by amending subsection <br />(a)(12) thereof and by adding subsection (j) thereto to read <br />as follows: <br /> <br />Section 33-32 <br /> <br />Utility and Street Improvements. <br /> <br />(a) In subdivisions, or part~ of subdivision, improvements <br />shall be provided as follows: <br /> <br />(1) ... (11) <br /> <br />(12) <br /> <br />Culverts shall be designed in accordance with the <br />Virginia Department of Transportation design <br />standards and details. Endwalls shall be provided <br />as required by, the City Engineer and shall conform <br />to Virginia Department of Transportation standards <br />or City standards. The developer shall provide for <br />soil bearing investigations to determine foundation <br />requirements. Pilings for culvert support shall be <br />provided if needed. Ample waterway shall be <br />provided for in culvert design, based on five (5) <br />year storm recurrence and the drainage area served <br />by the culverts. When requested by the City <br />Engineer, the developer shall provide calculations <br />for major culverts and bridge crossings which shall <br />be based on a 25 year frequency to insure that no <br />flood hazard will result to the public <br />rights-of-way, or to residences or other structures. <br /> <br /> <br />
