AN ORDINANCE TO AMEND C~kPTER 33~OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 33-2, 33-2g, <br />33-32, AND 33-59 AND BY REPEALING SECTION 33-35 THEREOF <br />PERTAINING TO SUBDIVISIONS. ~ ' <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia-. <br /> <br /> 1. That Section 33-2 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended by adding the <br />definition of "LOT, FLAG" to read as follows: <br /> <br />Section 33-2. <br /> <br />Definitions. <br /> <br />LOT, FLAG. A lot, the building area or prlnc]pa! use area of <br />which does not abut a public street, but is connected thereto <br />by a narrow strip of land (the "flagpole" or "panhandle"), <br />which is part of the lot. For the purpose of this Chapter, a <br />lot may be classified as a flag lot if its front property line <br />abuts the rear property line of another lot or if it is <br />connected to a street by a strip of land which has an average <br />width less than 30 percent of the width of the lot measured at <br />the front building setback like. The "front property line" of <br />a flag lot shall mean the interior property line most parallel <br />to and nearest the street from which access is obtained. <br /> <br /> 2. That Section 33-20 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended by adding thereto <br />subsection (j) to read as follows: <br /> <br />Section 33-20. Lots. <br /> <br />(a) ... (i) <br /> <br />(j) <br /> <br />Flag lots may be permitted if the proposed flag lot <br />makes it possible to better utilize an irregularly <br />shaped property, or if the flag lot is used to <br />eliminate direct access to a collector or an <br />arterial street. <br /> <br />In all cases, the following requirements must be <br />met: <br /> <br />(1) The flag lot shall not access an arterial <br />street. <br /> <br />(2) No part of the flag lot's access to the street <br />(the "flagpole" or "panhandle") shall be less than <br />20 feet in width for residentially zoned lots and 50 <br />feet in width for non-residentially zoned lots. <br /> <br /> <br />
