AN ORDINANCE TO AMEND CHAPTER 38 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 38-166, <br />38-168(b), 38-168(d), 38-170, 38-174(a), 38-174(e), 38-t85(a), <br />and 38-187(a), AND BY REPEALING SECTION 38-180 THEREOF <br />PERTAINING TO WATER BACKFLOW PREVENTION AND CROSS-CONNECTION <br />CONTROL. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 38-166 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended by amending the <br />definition of "Director" contained therein to read as follows: <br /> <br />Section 38-166. Definitions. <br /> <br /> "Director" means the director of the department o'f public <br />utilities or his designee. <br /> <br /> 2. That Sections 38-168(b), 38-168(d), 38-170, <br />38-174(a), 38-174(e), 38-185(a), and 38-I87(a) of the Code of <br />the City of Portsmouth, Virginia, 1988, be amended to read as <br />follows: <br /> <br />Section 38-168. <br /> <br />Inspection to be at reasonable hours, etc.; <br />warrant to enable inspection; termination of <br />service to uninspected premises. <br /> <br /> (b) In addition to the warrant procedure set forth in <br />subsection _(a) of this section, the director may commence <br />administrative proceedings to discontinue water service to <br />uninspected premises. Except in emergency cases involving the <br />imminent risk of pollution of the city water supply, the <br />director shall give ten working (10) days' written notice to <br />the owner or occupant of the affected premises or to a <br />responsible agent of his intention to terminate the water <br />service. The director shall afford to the owner, occupant or <br />agent a hearing on the question of whether water service shall <br />be terminated.
