Each person so <br />ticketed mayr within seventy-two (72) hours from the time when <br />such notice was given or attached to the vehicle, pay the sum <br />of twenty-five dollars ($25.00) due to his vehicle being <br />illegally parked in violation of this section. Upon failure <br />of the violator to pay the penalty for the violation noted <br />herein within eight (8) days from the date of violation, a <br />summons or warrant for the prosecution of the violation shall <br />be issued according to law, without necessity of a warrant <br />being obtained by the owner of such private parking area. Any <br />person convicted of a violation of this section shall be <br />punishable by a fine not to exceed one hundred dollars <br />($100.00). <br /> <br /> (c) In any prosecution under subsection (a), proof that <br />the vehicle described in the summons, ticket, or warrant was <br />parked in violation of subsection (a), together with proof <br />that the defendant was at the time the registered owner of the <br />vehicle, shall constitute in evidence & prima facie <br />presumption that the registered owner of the vehicle was the <br />person who committed the violation. <br /> <br />Section 22-709. <br /> <br />Duty of driver approaching pedestrian guided <br />by dog or carrying white or metallic cane. <br /> <br /> (a) Whenever a totally or partially blind pedestrian is <br />crossing or attempting to cross a public street or highway <br />guided by a dog or carrying a cane, which is predominantIy <br />metallic or white in color, with or without a red tip, the <br />driver of every vehicle approaching the intersection or place <br />of crossing shall bring his vehicle to a full stop before <br />arriving at such intersection or place of crossing, unless <br />such intersection or place of crossing is controlled by a <br />law enforcement officer or traffic light. <br /> <br /> (b) Any person violatin~ any provision of this section <br />shall be guilty of a Class 3 misdemeanor. <br /> <br /> 2. That Section 22-3 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended by adding subsection <br />(f) thereto, to read as follows: <br /> <br /> (f) Notwithstanding any other provision of this section, <br />in cases involving a violation of sections 46.2-341.24 or <br />46.2-341.31, of the Code of Virginia, the arresting officer <br />shall take the person before a magistrate as provided in <br />section 46.2-341.26 of that Code. The magistrate may issue <br />either a summons or a warrant as he shall deem proper. <br /> <br /> <br />
