22 A RESOLUTION GRANTING A USE PERMIT TO ANNE MCGLYNN FOR THE OPERATION OF A BED AND BREAKFAST INN AT 222 NORTH STREET. WHEREAS, Anne McGlynn has made application pursuant ~40.102.2 (B) [1) of the Code of the City of Portsmouth, Virginia, 1988, for the granting of a use permit as hereinafter-described; and to WHEREAS, the applicant and the done all things required to be done application; and Planning Director have in connection with said WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: That the use for which the use permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proDosed use; (b) Will not be detrimental to the public use or injurious to the property or improvements of the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. ® Anne McGlynn is hereby granted a use permit pursuant to §40.102.2 (B) (1) of the Code of the City of Portsmouth, Virginia, 1988, for the operation of a bed and breakfast inn on property located at 222 North Street and being more particularly described as: UP-90-5 Beginning on the north right-of-way of North Street at a point 50' east from the east right-of- way of Middle Street; thence north 200'+ to a point; thence east 47'+ to a point; thence south 200'+ to the north rightlof-way of North Street; thence-- west along said right-of-way 47'+ to the point of beginning. -- The use permit is approved subject to the following conditions:
