14 A RESOLUTION GRANTING A USE PE~IT TO CGX ENVIRONMENTAL SYSTEMS OF PORTSMOUTH, INC. FOR THE OPERATION OF A GARBAGE AND WASTE INCINERATOR AT 3991 ELM AVENUE, PORTSMOUTH, VIRGINIA. WHEREAS, CGX Environmental Systems of Portsmouth, Inc. has made application pursuant to Section 40-69(b) of the Code of the City of Portsmouth, Virginia, 1988, for the granting of a use permit as hereinafter described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; and (b) Will not be detrimental to the public use-or injurious to the property or improvements of the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. CGX Environmental Systems of Portsmouth, Inc. is hereby granted a use permit pursuant to Section 40-69(b) of the Code of the City of Portsmouth, Virginia, 1988, for the operation of a garbage and waste incinerator on property located at 3991 Elm Avenue, Portsmouth, Virginia and being more particularly described as: UP-90-2 Beginning at the northeast intersection of Elm Avenue and Veneer Road and thence north along the east right-of-way of Veneer Road 710' ~ and thence northea'st 40' + to a point and thence easterly 200' + to a ~oint and thence northeast 10' + to a point and thence easterly 60' + to a point to establish the true point of beginning; thence south 706' + to a point thence east 663'
