12 <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO LILLIAN C. VELASCO TO <br />OPERATE A CONVALESCENT HOME AT 3736 TURNPIKE ROAD, <br /> <br /> WHEREAS, the Council of the City of Portsmouth, Virginia, <br />granted a use permit to Mr. and Mrs. Thomas B. Velasco to <br />operate a private residence and home for the elderly near the <br />intersection of Utah Street and Turnpike Road on January 8, <br />1980, which permitted no more than nine (9) elderly female <br />guests in the convalescent and nursing home; and <br /> <br /> WHEREAS <br />amended said <br />residency by <br /> <br />· the Council of the City of Portsmouth, Virginia, <br />use permit on October 25, 1983, to permit <br />not more than twelve (12) elderly persons; and <br /> <br /> WHEREAS <br />amended said <br />residency by <br />and <br /> <br />, the Council of the City of Portsmouth, Virginia, <br />use permit on October 23, 1984, to permit <br />not more than thirty-two (32) elderly persons; <br /> <br /> WHEREAS, Lillian C. Velasco has made application pursuant <br />to Section 40-75 (b) of the Code of the City of Portsmouth, <br />Virginia, 1988, to operate a convalescent home for <br />forty-four (44) residents at 3736 Turnpike Road; and <br /> <br /> WHEREAS, the applicant and the Planning Director have <br />done all things required to be done in connection of said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said used permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use permit hereinafter <br />described is sought: <br /> <br /> (a) Will not adversely affect the health and safety <br />of persons residing and working in the neighborhood of the <br />proposed use; <br /> <br /> (b) <br />injurious to <br />neighborhood; <br /> <br /> Will not be detrimental to the public <br />the property and improvements in the <br /> and <br /> <br />use or <br /> <br /> (c) Will be in accordance with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. That Lillian C. Velasco is hereby granted a use <br />permit pursuant to Section 40-75 (b) of the Code of the City <br />of Portsmouth, VirginIa, to operate a convalescent home at <br />3736 Turnpike Road, such site being more particularly <br />described as follows: <br /> <br /> <br />
