72 A RESOLUTION AUTHORIZING AND CREATING THE AUXILIARY DEPUTIES PROGRAM FOR THE SHERIFF'S DEPARTMENT OF THE CITY OF PORTSMOUTH, AND AUTHORIZING THE SHERIFF TO APPOINT AUXILIARY DEPUTIES AND GOVERN SAME. WHEREAS, it is in the City's best interest and it is therefore necessary to appoint Auxiliary Sheriff's Deputies for the performance of duties which the Sheriff's Department is mandated to perform; WHEREAS, the governing body of a city may employ a greater number of law-enforcement deputies than fixed by the Compensation Board, provided that the city shall pay the total compensation and all employer costs for such additional deputies; and WHEREAS, Auxiliary Sheriff's Deputies shall be deemed employees of the City for Worker's Compensation purposes only, provided, that the governing body of the City has adopted a resolution acknowledging the Auxiliary Sheri-ff's Deputies as employees for the purposes of the Worker's Compensation Act, pursuant to Section 65.1-4.1 of the Code of Virginia, 1950, as amended; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the Auxiliary Deputy Program for the Sheriff's Department of the City of Portsmouth, Virginia, be created, and the Council acknowledges the Auxiliary Sheriff's Deputies as employees only for the purposes of the Worker's Compensation Act in accordance with Section 65.1-4.1 of the Code of Virginia, 1950, as amended. BE IT FURTHER RESOLVED that the Sheriff of the City of Portsmouth is authorized to create the Auxiliary Deputies Program and appoint and govern said Auxiliary Sheriff's Deputies. And that the Sheriff shall have the authority to prescribe the uniform, organization and such rules and ~egulations as he shall deem necessary for the operation of the Auxiliary Deputies Program.
