(3) <br /> <br />Site plan requirements of the Zoning <br />Ordinance, the Chesapeake Bay <br />Preservation Act and regulations, <br />and related City ordinances. <br /> <br /> (d) A landscaping plan must be approved by the <br />Director of Planning prior to the approval of the site <br />plan. The landscaping plan must comply with the <br />requirements of Chapter 36 of the City Code, as amended, <br />regarding tree retention or replacement and must meet the <br />following additional standards: <br /> <br />(1) <br /> <br />Any parking area, scales, unloading <br />areas, or equipment must be screened <br />from view from any public street by <br />a berm, landscaping screen, wall, or <br />any combination thereof. <br /> <br />(M) <br /> <br />The plan shall identify landscape <br />focal points at entrances and other <br />areas visible from public streets. <br />These focal points shall be <br />landscaped with a combination of <br />deciduous and coniferous trees and <br />shrubs. <br /> <br /> (e) Prior to commencement of any operation on the <br />subject property, the operator of this facility shall <br />provide evidence of compliance with all applicable <br />conditions of this use permit to the City Manager of the <br />City of Portsmouth or his designee. <br /> <br /> (f) The applicant or its assignee(s) or <br />successorls) shall be required to demonstrate compliance <br />on a periodic basis, and at all times shall comply, with <br />all applicable statutes, codes, ordinances, policies and <br />regulations of federal, state and local governments or <br />agencies that govern the subject use, and shall obtain <br />all necessary licenses and permits required by law for <br />this use prior to the commencement of operations. The <br />applicant or its assignee(s) or successor[s) shall submit <br />written documentation of compliance with State air and <br />wacer quality standards as required by the State Air <br />Pollution Control Board and the State Water Control Board <br />or their successors on a quarterly bas~s. The plant <br />shall be equipped with a continuous emission monitoring <br />system, and the applicant or its assignee(s) or <br />successor(s) shall retain all records of emissions for no <br />less than two years for the purpose of inspection by the <br />City of Portsmouth at any time. <br /> <br /> (g) If violations of the conditions of this use <br />permit occur, the City Manager of the City of Portsmouth <br />or his designee shall be empowered to require that <br /> <br /> <br />
