A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY A PARCEL <br />OF PROPERTY LOCATED BETWEEN THE RIGHT-OF-WAY OF CSX <br />TRANSPORTATION, INC. AND THE NORFOLK AND PORTSMOUTH BELT LINE <br />RAILROAD COMPANY ALONG WITH AN EASEMENT TO CONSTRUCT A <br />RAILROAD CROSSING WITHIN THE RIGHT-0F-WA¥ OF SYER ROAD TO <br />NORFOLK AND PORTSMOUTH BELT LINE RAILROAD COMPANY- <br /> <br /> WHEREAS, the Norfclk and Portsmouth Helt Line Railroad <br />Company and CSX Transportation, Inc. find it necessary to <br />construct a connector between their respective main lines in <br />the City of Portsmouth due to the heavy volume of traffic and <br />commerce between them; and <br /> WHEREAS, the Council of the City of Portsmouth deems it <br />to be in the best interest of the health, safety, welfare, <br />comfort and convenience of its citizens that such a connector <br />be constructed; <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br /> of Portsmouth, Virginia, that the City Manager be, and hereby <br /> is, authorized to convey the hereinafter described property to <br /> the Norfolk and Portsmouth Belt Line Railroad Company under <br /> such terms and conditions as he shall deem in the best <br /> interest of the City, to-wit: <br /> <br />PARCEL ONE <br /> <br /> ALL THAT certain piece or parcel of land, <br />situate in the City of Portsmouth, Virginia, <br />designated "PROPOSED 50' RIGHT-OF-WAY" and <br />shown on a plat (the "Plat") entitled <br />"EASEMENT AND RIGHT-OF-WAY PLAT FOR NORFOLK <br />AND PORTSMOUTH BELT LINE RAILROAD COMPANY," <br />dated January 2, 1990, revised June 28, 1990, <br />made by Stephen I. Boone & Associates, P.C., <br />Land Surveyor, Portsmouth, Virginia, recorded <br />herewith, which land is bounded and described <br />as follows: <br /> <br /> Beginning at a point in the southern <br /> right-of-way line of Syer Road, said point <br /> being S 61° 50' 00" W 440.31 feet from the <br /> intersection of said right-of-way line with <br />-the western right-of-way line of the Norfolk <br /> and Portsmouth Belt Line Railroad Company <br /> (the "Belt Line"); thence along a curve to <br /> the right with a radius 537.80 feet, 481.66 <br /> feet to a point in the western right-of-wa~ <br /> line of the property of the Belt Line (the <br /> "Belt Line Right-of-Way"), said point being <br /> 468.33 feet from the intersection of the <br /> Belt Line Right-of-Way with the southern <br /> <br /> <br />
