19 <br /> <br />A RESOLUTION EXPRESSING THE C~NCERN OF THE COUNCIL OF THE CITY <br />OF PORTSMOUTH TO THE POSSIBLE CLOSURE OF THE NAVAL ELECTRONIC <br />ENGINEERING CENTER IN PORTSMOUTH, VIRGINIA. <br /> <br /> WHEREAS, on or about November 5, 1990, the Senate and <br />HoUse of Representatives of the United States of America <br />enacted the National Defense AUthorization Act for Fiscal Year <br />1991, PUblic Law 101-510 (the "Act"), which was subsequently <br />signed into law by the President; and <br /> <br /> WHEREAS, the Act includes a provision entitled the <br />Defense Base Closure and Realignment Act of 1990 whose purpose <br />is to provide a fair process that will result in the timely <br />closure and realignment of military installations inside the <br />United States and establish an independent commission known as <br />the Defense Base Closure and Realignment Commission (the <br />"Commission"); and <br /> <br /> WHEREAS, <br />Defense shall <br />list of bases <br /> <br />on or before April 15, 1991, the Secretary of <br />submit to Congress and the Commission a proposed <br />for closure and realignment; ~and <br /> <br /> WHEREAS, the Commission is authorized to change <br />on the list for closure and realignment in limited <br />circumstances; and <br /> <br />the bases <br /> <br /> WHEREAS, no later than JUly 1, 1991, the Commission shall <br />report to the ~resident its findings in review of the <br />Secretary of Defense's selection process; and <br /> <br /> WHEREAS, ~e President shall on or before ~ly 15, 1991, <br />approve or reject the Commission's report and, if rejected, <br />such report will be resRbmitted within thirty (30) days; and <br /> <br /> WHEREAS, if the President accepts lhe report, he.shall <br />formally propose it to Congress for enactment; and- <br /> <br /> WHEREAS, the base closures and realignments contained <br />the Commission's_report approved by the President may be <br />implemented forty-five (45) day's after it is sabmitted to <br />Congress; and <br /> <br /> WHEREAS, the Secretary of the Navy, by memorandum dated <br />December 14, 1990 (the "Navy Memorandum"), reviewed and <br />endorsed a concept to consolidate certain Navy Research <br />Development, Tests and EvaluatiQn ("RDT&E") activities~ <br />throughout the country pursuant to the Act; amd <br /> <br /> <br />
