See. 40-45.7. Residentisl parkin~ districts. <br /> <br /> In order to reduce or prevent congestion in the public streets and to reduce <br />hazardous traffic conditions resulting from the use of streets within areas zoned for <br />residential uses for the parking of vehicles by persons using districts zoned for <br />commercial or industrial uses; and to provide for adequate light, air, convenience <br />of access and to protect residential districts from polluted air, excessive noise, and <br />trash and refuse; and to protect the residents of residential districts from <br />unreasonable burdens in gaining access to their residences; and to promote <br />efficiency in the maintenance of streets in a clean and safe condition; and to facilitate <br />the creation of a convenient, attractive and harmonious community and to preserve <br />the value of property In residential districts; and to preserve the safety of children <br />and other pedestrians and to protect against danger and congestion in travel and <br />transportation; and to preserve peace, good order, convenience, and welfare of the <br />inhabitants of the city, the city manager is hereby authorized to designate <br />residential parking districts under the following conditions. <br /> <br /> Whenever the city manager or his designee shall determine that the streets of a <br />particular district or discrete portion of a district in which residential uses are <br />permitted and commercial and industrial uses are not permitted are being used for <br />parking by the operators of vehicles while the operators of those vehicles are using <br />districts or portions of districts in which commercial or industrial uses are permitted <br />and the average number of vehicles parking in such a manner is in excess of twenty- <br />five (25) per cenl of the number of parking spaces on such streets and the total <br />number of spaces actually occupied by any vehicle exceeds seventy-five (75) per <br />cent of the number of spaces on such streets, on the weekdays of any month, <br />determined by a survey, the city manager or bis designee may by rule, regulation <br />or order provide for the restriction of parking during the hours when such use has <br />been found on those streets of those districts or portions of districts found by the <br />survey to have been affected. In such cases, the city manager shall cause <br />appropriate signs giving notice of the restricted parking to be posted on those <br />streets restricting such parking under the conditions established by such order, <br />rule or regulation which shall be applicable to all parking except parking by the <br />holders of permits to be granted only under the following conditions: <br /> <br />(a) <br /> <br />To the owner or the operator of a motor vehicle who resides, owns real <br />property or has a leasehold interest in real property within the area where <br />parking is so restricted, to be limited to that particular area in which <br />parking is so restricted and to be limited to one permit for each vehicle <br />owned or used by that person and described in the application or amendment <br />to it submitted by that person. <br /> <br />(b) <br /> <br />To persons who are visitors of any residence of any particular area in which <br />parking is so restricted, to be limited to that particular area in which <br />parking is so restricted, to be valid for a stated period but no more than <br />thirty (30) days, <br /> <br />(e) <br /> <br />On the application of any resident of the district, the city manager or his <br />designee, may issue permits to be valid for only one day and for no more <br />than four (4) hours on that day upon the showing by the resident that <br />during the hours for which the permits are to be issued, his residence will <br />be used in such a way consistent with its residential character and other <br /> <br />64 <br /> <br /> <br />
