1991-112 AN ORDINANCE TO AMEND CHAPTER 2 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTION 2-114 IHEREOF, PERTAINING TO RESTRICTIONS ON POLITICAL ACTIVITIES OF CITY EMPLOYEES. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Section 2-114 of the Code of the City of Portsmouth, Virginia, 1988, be amended to read as follows: Section 2-114. Political activities restricted. (a) The provisions of this section shall apply to all pay and classification plan employees of the City, the City Manager and all department heads and employees appointed by him, officers appointed by the City Council, and all staff assistants in those departments (including the City Clerk, City Attorney, and Real Estate Assessor). The provisions of this section shall not apply to members of boards and commissions who are not pay and classification plan employees of the City nor to members of the City Council. (b) It shall be unlawful for any person to address groups of officers or employees of the city supporting or opposing the candidacy of any person for public office while such officers or employees are at work during a regularly assigned period of duty or otherwise engaged in carrying out the official business and functions of the city; provided, however, that nothing in this section shall be construed to prohibit or prevent any officer or employee of the city from exercising his rights as a citizen to privately express his opinions on any political subject. (c) The restrictions of this section are designed to protect every employee's right to vote and to participate in political activities and to keep this richt free from interference, solicitation or dictation by any fellow employee, supervisor, official, or candidate. (d) No person to whom this section applies shall use the status or prestige of his or her position with the City on behalf of or in opposition to any candidate for elective office, including oneself. (e) No person to whom this section applies shall use any city funds, supplies, or equipment for political purposes, nor shall any such person wear his or her city uniform while participating in any manner in political activities. (f) No person to whom this section applies shall hold any local elected office or position including the office of Mayor or the position of City Councilperson while being employed by the City of Portsmouth.
