1991-111 <br /> <br />AN ORDINANCE TO AMEND CHAPTER 32 OF ~HE CODE OF THE CITY <br />PORTSMOUTH, 1988, BY AMENDING SECTION 32-154 THEREOF, <br />PERTAINING TO STREETS, SIDEWALKS AND LOCAL IMPROVEMENTS. <br /> <br />OF <br /> <br /> BE IT ORDAINED by the douncil of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 32-154 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended and re-ordained as <br />follows: <br /> <br />Section 32-154. <br /> <br />Erection or maintenance of aerial wires, <br />cables, etc., in underground districts. <br /> <br /> (a) Et shall be unlawful for any person to erect or <br />maintain agrial wires, cables or poles within the underground <br />utility districts described in this article after the dates <br />applied to the respective districts in Section 32-153. <br /> <br /> (b) No exception shall be granted unless the City <br />Manager fihds that such requested exception would not be <br />injurious to the neighborhood, that denial would create severe <br />and undue hardship for the person, and that denial would <br />result in no appreciable benefit to the neighborhood. The <br />granting of an exception shall be at the sole discretion of <br />the City Manager. <br /> <br /> 2.
