AN ORDINANCE TO AMEND SECTION <br />OF PORTSMOUTH, VIRGINIA, 1988, <br />TRUCKS. <br /> <br />37-248 OF THE CODE OF THE CITY <br />AS AMENDED, RELATING TO TOW <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 37-248 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended to read as follows: <br /> <br />Section 37-248. <br /> <br />Duty to notify police of removal <br />of vehicle. <br /> <br /> (a) Prior to or simultaneously with the removal of any <br />vehicle by a tow truck operator, or any person or entity <br />repossessing any vehicle as allowed by law, the operator of <br />the tow truck, or person or entity repossessing the vehicle, <br />shall notify the police dispatcher of such removal. Such <br />notification shall include the following information: (1) the <br />complete license number, and state of issue; (2) the year of <br />expiration of said license; (3) the complete vehicle <br />identification number; (4) the make, model and color of the <br />vehicle; (5) the person or entity requesting the removal; and <br />(6) any other information that may be required by the police. <br />In the instance that any of the information provided as <br />required herein is found to be incorrect, the tow truck <br />operator, or person or entity responsible for the removal of <br />vehicle, upon notification by the police, shall provide the <br />correct information. This provision shall not apply to <br />disabled vehicles towed at the request of the vehicle's <br />owner. <br /> <br /> (b) In all matters where vehicles are towed or removed <br />at the request or direction of any person or entity other <br />than an agency of the City of Portsmouth, the City shall have <br />no liability for any cost associated with such removal. <br /> <br /> (c) Failure to comply with the reporting or <br />notification requirement as described in subsection (a) <br />constitutes a traffic infraction and shall be punishable by a <br />fine of non more than $100.00. Such failure to report shall <br />limit the amount which may be charged for the storage and <br />safekeeping of the towed vehicle t'o an amount no greater than <br />that charged for one day of storage and safekeeping. <br /> <br /> The provisions of this ordinance shall take effect on <br />September 1, 1991. <br /> <br /> <br />
