AN ORDINANCE TO AMEND CHAPTER 38 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 38-57 AND <br />38-94(a) THEREOF, PERTAINING TO WASTE, SEWERS AND SEWAGE <br />DISPOSAL. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 38-57 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended to read as follows: <br /> <br />Section 38-57. <br /> <br />City not liable for damages caused by <br />bursting of water mains or pipes, shutting <br />off the water or failure of water supply. <br /> <br /> The city shall not be liable for any damage, including <br />water discoloration or any damage resulting therefrom, <br />resulting from the bursting of any water main, service pipe or <br />cock,, from the shutting off of water for repairs, extensions <br />or connection or from the accidental failure of the water <br />supply from any cause whatsoever. <br /> <br /> 2. That Section 38-94(a) of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended to read as follows: <br /> <br />Section 38-94. <br /> <br />Discontinuing service for failure to pay and <br />other remedies. <br /> <br /> (a) If a bill rendered pursuant to section 38-93 is not <br />paid within fifteen (15) days from the due date set forth on <br />the bill, service to the premises may be discontinued without <br />further notice, and~ in addition any and all past due bills, <br />charges, and interest thereon ~ay be recovered by the city by <br />action at law or suit in equity, and shall constitute a lien <br />against the property, ranking on a parity with liens for <br />unpaid taxes. <br /> <br />3.
