(b) Bituminous concrete or Portland cement concrete <br />shall be utilized for all street improvements and widening and <br />shall be designed and installed subject to the approval of the <br />city engineer according to the street classification and use. <br />All parking facilities shall be paved with bituminous concrete <br />or Portland cement concrete. The city engineer may require <br />paving surfaces and/or construction techniques which minimize <br />surface storm runoff in areas where it is deemed necessary. <br />The developer may select precast interlocking blocks, <br />porous-type asphalt paving, detention basins, or other methods <br />approved by the city engineer. All drainage calculations for <br />parking areas shall utilize, as a minimum, storm water runoff <br />co-efficients for the parking lot as if paved in its entirety <br />with nonporous bituminous concrete. In M-1 and M-2 industrial <br />zones, storage lots and service areas away from street <br />frontage will not require paving or sealing, as long as same <br />do not result in dust, dirt, sand, gravel and similar <br />materials being deposited or tracked on public streets or <br />rights-of-way. <br /> <br /> The improvements to parking facilities in this Article <br />may be phased in in accordance with the schedule of <br />improvements approved by the city engineer after considering <br />the proposed use of the parking facility including the <br />anticipated number of persons utilizing the area during the <br />period of construction of the parking facility. <br /> <br />Section 32-272. Parking lot nuisances; remedies. <br /> <br /> (a) Ail parking lots shall be designed, constructed and <br />maintained in such a manner that dust, dirt, sand, gravel and <br />similar materials will not be deposited on public streets or <br />rights-of-way. The owner or occupant of any land within the <br />city in which a parking lot exists shall be responsible for <br />cleanup operations. <br /> <br /> (b) The depositing and tracking of dust, dirt, sand, <br />gravel and similar materials from a parking lot shall be <br />unlawful and shall also constitute a nuisance. Whenever it is <br />determined by the City that such a nuisance exists, the owner <br />or occupant of the site shall be given notice in writing of <br />the existence of the nuisance, and if the nuisance is not <br />abated within fifteen (15) days of receipt of the written <br />notice, the city may cause the nuisance to be abated and bill <br />the owner or occupant thereof for all costs incurred thereby. <br />In addition, the city engineer may require that unimproved or <br />graveled lots be promptly sealed with bituminous concrete, <br />Portland cement concrete or bituminous surface treatment <br />(double prime and seal), or be modified at the expense of <br />the owner or occupant as may be necessary to assure <br />elimination of the nuisance. The same requirement may also be <br />imposed on parking lots with paved surfaces which have become <br />neglected or not maintained, thus causing the nuisance. <br /> <br /> <br />
