AN ORDINANCE TO AMEND CHAPTER 17 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTION <br />17-49, THEREOF, PERTAINING TO THE HOUSING BOARD OF <br />ADJUSTMENTS AND APPEALS. <br /> <br /> BE IT ORDAINED by the Council of the City of <br />Pcrtsmouth, Virginia: <br /> <br /> 1. That Section 17-49 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended to read as <br />follows: <br /> <br />Section 17-49. Grant of extension of time for <br /> performance of action required by code. <br /> <br /> When the housing code specifies that the <br />performance of any action shall be 'completed within a <br />stated time after notice requiring such action, if the <br />board finds that compliance therewith would cause undue <br />hardship on an owner, the board may grant a reasonable <br />extension of such time. Ne such extension shall be <br />granted for more than eight (8) months from the date of <br />such notice. In the event the board shall find that an <br />undue financial hardship exists, then t~e board may <br />grant an extension of time beyond the eight (8) month <br />limit.~All such extensions shall be subject to review-as <br />deemed n~cessary by the board or upon application of the <br />Director of Environmental Services. When reviewing <br />applications based on undue financial hardship, the <br />board may consider the applicant's income from all <br />sources, general financial worth, age, physical and <br />mental condition, costs associated with reaching a <br />condition of compliance,, and any and all other e_vidence <br />that -may 5e properly related to the ability'~f the <br />applicant to comply with the housing code. No such <br />extension shall be granted if an inspection of the <br />property~ reveals a condition that ~akes the -property <br />dangerous to the general public or the occupants thereof <br />or a nuisance. <br /> <br /> 2."
