AN ORDINANCE TO AMEND CHAPTER 17 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTION 17-49, THEREOF, PERTAINING TO THE HOUSING BOARD OF ADJUSTMENTS AND APPEALS. BE IT ORDAINED by the Council of the City of Pcrtsmouth, Virginia: 1. That Section 17-49 of the Code of the City of Portsmouth, Virginia, 1988, be amended to read as follows: Section 17-49. Grant of extension of time for performance of action required by code. When the housing code specifies that the performance of any action shall be 'completed within a stated time after notice requiring such action, if the board finds that compliance therewith would cause undue hardship on an owner, the board may grant a reasonable extension of such time. Ne such extension shall be granted for more than eight (8) months from the date of such notice. In the event the board shall find that an undue financial hardship exists, then t~e board may grant an extension of time beyond the eight (8) month limit.~All such extensions shall be subject to review-as deemed n~cessary by the board or upon application of the Director of Environmental Services. When reviewing applications based on undue financial hardship, the board may consider the applicant's income from all sources, general financial worth, age, physical and mental condition, costs associated with reaching a condition of compliance,, and any and all other e_vidence that -may 5e properly related to the ability'~f the applicant to comply with the housing code. No such extension shall be granted if an inspection of the property~ reveals a condition that ~akes the -property dangerous to the general public or the occupants thereof or a nuisance. 2."
