1991-20 <br /> <br />AN ORDINANCE TO AMEND CHAPTER~3 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 3-184, <br />3-185(c), 3-186(b), 3-186(c), 3-186(d), 3-188(a) AND 3-t88(e) <br />THEREOF, AND BY ENACTING SECTIONS 3-190, 3-191, 3-192, AND <br />3-193 PERTAINING TO BINGO GAMES AND RAFFLES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Sections 3-184, 3-185(c), 3-186(b), 3-186(c),' <br />3-186(d), 3-188(a) and 3-188(e) of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended to read as follows: <br /> <br />Section 3-184. <br /> <br />Membership lists; limitation on <br />participation in management, operation or <br />conduct. <br /> <br /> (~) As part of the application process and prior to <br />being granted a permit under this article, an organization <br />shall provide a complete list of all persons who have been <br />members of such organization for at least ninety (90) days. <br />Only the persons designatedon such list shall participate in <br />the management, operation, or conduct of any bingo game or <br />raffle. Information sufficient to establish the bona fides of <br />membership may be required by the city manager. Members added <br />after the issuance of a permit shall not be permitted'to <br />participate in the management, operation or conduct of any <br />bingo game or raffle until their names have been added to the <br />membership list maintained by the city manager or his <br />designated representative, and such amended membership list <br />shall have been on file with the city for at least ninety (90) <br />days prior to such participation. The spouse of any such'bona <br />f~de member may participate in the operation or cohduct of a <br />bingo game or raffle if a bona fide member is present. <br /> <br /> (b) No member of any organizati-on <br />manage o~ work any bingo game or r~ffle <br />organizations during any calendar year. <br /> <br />shall be permitted to <br />for more than two (2~ <br /> <br />~ection 3-185. <br /> <br />Financial records and reports gpnerally. <br /> <br /> (c) Ail monies-in excess of fifteen (15) per centum of <br />the total annual net receipts from bingo or raffles shall be <br />donated to and/or expended upon charitable activities or <br />projects. For the purposes of this article, "net receipts" zs <br />defined as gross receipts less expenses. Annual net receipts <br />as defined herein can be cumulative for no more than three (3) <br />years and .then only if a sponsoring organization has <br />identified a specific charitable project for which these funds <br />will be. used. Such notification shall be made in writing to <br /> <br /> <br />
