depth and/or building setback llne would otherwise permit, the required <br />front yard depth and building setback line for such zone lot may be modified <br />to the average of the front yards of the existing buildings on the adjoining <br />zone tots. <br /> <br /> (b) SETBACK OF BUILDING ADDITIONS. Where a building with a non- <br /> conforming side or rear setback was in place at the time of the adoption of <br /> this ordinance, a special exception may be granted lo allow construction of <br /> an addition with the same non-conforming setback, provided however, that <br /> the total square footage of that portion of the new addition which does not <br /> conform to the setback may not exceed that total square footage of the <br /> portion of the existing structure which encroaches on the required setback. <br /> <br />(c) CHURCH PARKING LOTS. Upon application of churches and places of <br /> worship situated in areas zoned RM-60 and OR-60 an exception to the off- <br /> street parking requirements of Section 40-45 may be granted, provided that <br /> it is established that the church or place of worship was in existence on <br /> April 25, 196]; and thai the abutting area is densely occupied to an extent <br /> of no less than five thousand (5000) persons per gross square mile. <br /> <br />(d) UNENCLOSED CARPORTS IN RESIDENTIAL DISTRICTS. The board may <br /> approve an exception to rear and side yard requirements for a carport which <br /> will he unenclosed on at least three sides only if it finds the following <br /> conditions to exist: <br /> <br />(e) <br /> <br /> (1) The property is zoned for residential use, <br /> <br /> (2) There is no reasonable opportunity to construct a carport on the lot <br /> in compliance with the dimensional requirements of this Chapter, <br /> <br />(3) No roof overhang or structural support wiL~ be :ocated closer than two <br /> and one half (2.5) .feet from any property line. <br /> <br />HISTORIC DISTRICTS. The board is empowered to grant special exceptions <br />for non-conforming uses in Historic Districts meeting the conditions stated <br />in Section 40-53.4. <br /> <br />Sec. 40-196.1. Procedures. <br /> <br /> The procedure for applying for and obtalrAng a special exception shall be the <br />same as set forth in the Code of Virg/nia. <br /> <br />Sec. 40-196.2. Conditions. <br /> <br /> In authorizing a special exception, the board of zoning appeals may impose such <br />conditions regarding the location, character and other features of the proposed <br />structure or use as it may deem necessary in the public interest, and may require <br />a guarantee or bond to insure present and future compliance with the conditions are <br />imposed. <br /> <br />136 <br /> <br /> <br />
