(a) The strict application of the ordinance would produce undue hardship; <br /> <br />(b) Such hardship is not shared generally by ether properties in the same <br /> zoning district and the same vicinity; <br /> <br />(c) <br /> <br />The authorization of such variance will not be of substantial detriment to <br />adjacent property and that the character of the district will not be ctmnged <br />by granting the variance; <br /> <br />(d) The variance is in harmony with the general purpose and intent of the <br /> ordinance and preserves its spirit; <br /> <br />(e) Granting the variance secures the public safety and welfare and does <br /> substantial justice; <br /> <br />(f) <br /> <br />Compliance with Code provisions precludes reasonable use of the property. <br />The fact that the property may be utilized for greater profit, however, will <br />not be considered adequate justification for granting a variance; <br /> <br />(g) The hardship is not the result of the applicant's own actions. <br /> <br /> No variance shah be approved unless the board of zoning appeals finds that the <br />condition or situation of the property concerned or the intended property use is not <br />of so general or recurring a nature as to make reasonably practicable the formulation <br />of a general regulation to be adopted as an amendment to the ordinance. <br /> <br />Sec. 40-195.2. Procedures. <br /> <br /> The procedure for applying for and obtaining a variance shall be the same as set <br />forth in the Code of Virginia. <br /> <br />Sec. 40-195.3. Conditions. <br /> <br /> In authorizing a variance, the board of zoning appeals may impose such conditions <br />regarding the location, character and other features of the proposed structure or <br />use as it may deem necessary in the public interest, and may require a guarantee or <br />bond to insure thai the conditions imposed are being and will continue to be complied <br />with. <br /> <br />Sec. 40-196. Requirements for special exception. <br /> <br /> The board of zoning appeals may grant special exceptions in accordance with the <br />following standards, providing that the board finds that such special exception will <br />not adversely affect neighboring properties and will not be contrary to the purposes <br />of this Ctmpter: <br /> <br />(a) <br /> <br />RESIDENTIAL DISTRICTS.
