ARTICLE XV. <br /> <br />ENFORCEMENT <br /> <br />Sec. 40-181. Violations. <br /> <br /> Any of the following shall be a violation of this Chapter and shall be subject to the <br />enforcement remedies and penalties provided by this Chapter and by state law: <br /> <br />(a) <br /> <br />To engage in any development, use, construction, remodeling or other <br />activity of any nature upon the land and improvements thereon subject to <br />the jurisdiction of the City of Portsmouth without all of the required <br />permits, certificates or other forms of authorization as may be set forth in <br />this Chapter to conduct or engage in such activity; <br /> <br />(b) <br /> <br />To engage in any development, use, construction, remodeling, or other <br />activity of any nature in any way inconsistent with the permit, certificate, <br />or other form of authorization granted for such activity by the city; <br /> <br />(e) <br /> <br />To violate, by act or omission, any term, condition, or qualification placed <br />by the city upon a required permit, certificate or other form of authorization <br />granted by the city to allow the use, development or other activity upon <br />land or improvements thereon; <br /> <br />(d) <br /> <br />To erect, construct, reconstruct, alter, maintain or use any building or <br />structure or to use any land in w[olation or contravention of any zoning, <br />subdivision or general regulation of this code or any amendment thereto; <br /> <br />(e) To continue any of the above stated violations. Each day of a violation shall <br /> be considered a separate offense. <br /> <br />Sec. 40-182. k~forcement and Remedies. <br /> <br /> Any violation or attempted violation of this Chapter or of any condition or <br />requirement adopted pursuant hereto may be restrained, corrected or abated as the <br />case may be by injunction or other appropriate proceeding pursuant to the Code of <br />Virginia. <br /> <br /> (a) The city may seek such criminal penalties as are provided below by Section <br /> 40-183. <br /> <br /> (b) The city may stop work on any building or structure on any land on which <br /> there is or has been an uncorrected violation of a provision of this Chapter <br /> or of a permit or other form of authorization issued hereunder in accordance <br /> with its powers to stop work under the Virginia Uniform Statewide Building <br /> Code; the director of environmental services, or any other interested <br /> official of the city, may institute any appropriate action or proceeding to <br /> prevent the unlawful construction, reconstruction, alteration, or repair of <br /> any structure, or the unlawful use of any land, to restrain, abate, or <br /> correct such violations, to prevent the occupancy of such structures, or to <br /> prevent any unlawful act, conduct, business, or use in or about such <br /> premises. <br /> <br />131 <br /> <br /> <br />
