Sec-. 40-17~. DowntOWn design committee; establishment and membership. <br /> There is hereby created and established a downtown design committee. <br /> <br /> (a) The committee shall consist of seven (7) members to be appointed by city <br /> council for a term of three (3) years from the date of such appointment. Of <br /> members appointed, one (1) shall be appointed from at least three (3) <br /> nominees made by the Portsmouth Downtown Merchants' Association, one (1) <br /> shah be appointed from a~ least three (3) nominees made by the Portsmouth <br /> Chamber of Commerce, one (1) shall be a representative of the district and <br /> four (4) shall be chosen to provide professiona! expertise as architects, <br /> design professionals, real estate professionals or historians. Members of the <br /> committee shall serve without compensation. <br /> <br /> (b) The committee shall implement the purpose and objectives of the "Priority <br /> Action Program for Central Portsmouth," hereinafter referred to as "the <br /> plan" through the design guidelines and issuance of certificates of intent <br /> and compliance. <br /> <br /> (c) The committee shall meet as and when called upon by the chairman or by at <br /> least two (2) members of the committee. <br /> <br /> (d) The committee shah appoint a chairman and vice-chairman from among its <br /> members and a secretary who shall be an employee of the city planning <br /> commission. <br /> <br /> (e) The committee may employ a consultant and seek advice from any city <br /> departments as it deems it necessary. <br /> <br />Sec. 40-179.1. Certificate issuance authority. <br /> <br />(a) <br /> <br />Certificate of Intent. The downtown design committee shall have the power <br />and the duty to issue or deny a certificate of intent on all proposed building <br />and devalopment within the Downtown D-1 and D-2 Districts. The certificate <br />of intent shah contain specifications for use, building, height, bulk, <br />location (including setback requirements), required parking space, <br />landscaping, signs, and other design features of all buildings and other <br />improvements ~o be constructed, erected, or reconstructed in the D-1 <br />District. <br /> <br />(b) <br /> <br />Certificate of Compliance. The committee shall have the power and the duty <br />to issue or deny a certificate of compliance on any proposed modification, <br />alteration, reconstruction, construction, repair, maintenance activity, <br />including painting of an outer wall or part of a building or structure which <br />are subject to public view from a public street or other public place which <br />is to occur in the Downtown D-1 and D-2 Districts. <br /> <br />(c) <br /> <br />Limitation. Nothing in this Article shall be construed to prevent the owner <br />of such building, structure, or property in the Downtown D-i and D-2 <br />Districts from performing any maintenance, alteration or painting to the <br /> <br />129 <br /> <br /> <br />
