Sec. 40-174. Construction or conflicts in standards. <br /> <br /> Whenever the regulations made under authority of this Article require a greater <br />width or size of yards, courts or other open spaces, require a lower height of <br />building or less number of stories, require a greater percentage of lot to be left <br />unoccupied or impose other higher standards than are required in any other statute <br />or local ordinance or regulation, the provisions of the regulations made under <br />authority of this Code shall govern. Whenever the provisions of any other statute <br />or local ordinance or regulation require a greater width or size of yards, courts or <br />other open spaces, require a lower height of building or a less number of stories, <br />require a greater percentage of lot to be left unoccupied or impose other higher <br />standards than are required by the regulations made under authority of this Code, <br />the provisions of such statute or local ordinance or regulation shall govern. <br /> <br />Sec. 40-175. Effect on other permits. <br /> <br /> No person shah obtain a building permit, an excavation permit or a certificate of <br />occupancy or engage in any activity requiring such a permit unless such permit or <br />certificate is for construction or other activity consistent with the zoning and other <br />requirements and with the terms and conditions of any reviews and approvals under <br />this Chaplet. After the effective date of this Chapter, no person shall change the <br />use of land or a building, obtain a business license or obtain any other municipal <br />approval unless the proposed use, business or activity is consistent with the zoning <br />and other requirements and with the terms and conditions of any reviews and <br />approvals under this ChapTer. <br /> <br />DIVISION 2. ADMINISTRATIVE ENTITIES <br /> <br />Sec. 40-176. planning commission; establishment and membership. <br /> <br /> There is hereby created a city planning commission to be known as the planning <br />commission of the City of Portsmouth. The planning commission shall consist of seven <br />(7) members to be appointed by city council. The appointment and term of each <br />member shall be set by city council m accordance with the Code of Virginia. <br /> City council may appoint two (2) ex officio members of the planning commission <br />who shall serve as full members except that they shall not have the right to vote on <br />any matter. One nonvoting member shall be an employee of the City of Portsmouth <br />and one nonvoting member shall be an employee of the Portsmouth Redevelopment and <br />Housing Authority. <br /> <br />Sec. 40-176.1. OrganizatiOn. <br /> <br /> The planning commission shall, with the approval of city council, adopt by-laws <br />which govern its operations, establish its procedures, and provide for notice and <br />conduct of its meetings.
