No variance. <br /> <br /> If any person shall create or shall have atany time after April 25, 1961, created <br />a lot or parcel which fails to conform with the dimensional requirements of the <br />district in which it is located by selling part of a zone lot, as defined herein and <br />subject to the merger provisions of Section 40-162.1, such sale shall have no effect <br />fOr purposes of this Chapter and the lots and/or parcels shall still be considered as <br />part of one or more zone lots in accordance with Section 40-162.1. No variance shall <br />be granted to allow a deviation from the app~cable dimensional requirements on any <br />part of such zone lot, regardless of the ownership. <br /> <br />Sec. 40-163. Nonconforming uses. <br /> <br /> A use which was begun in conformance with applicable use standards in effect at <br />the time of such beginning, but which at a subsequent date fails to conform to <br />applicable use standards due to a change in the zoning map, in the Use Schedule or <br />in the text of this Chapter~ may be continued subject to the following requirements: <br /> <br /> (a) CHANGE OF TITLE. No change of title, possession, or right to possession <br /> shah affect the right to continue such use; <br /> <br /> (b) RESIDENTIAL USES. Any building in any industrial or commercial district, <br /> ineluding the Downtown Districts, which contains a nonconforming <br /> residential use may be used for any other nonconforming residential use, <br /> subject to the other requirements of this section and subject to the <br /> dimensional requirements of the RM-60 Multi-Family Residential District. If <br /> any building containing a residential use is rebuilt or remodeled to an <br /> extent exceeding thirty-three (33) percent of its then reproducible value, <br /> exclusive of foundations, the remode!ed building must contain 0nly uses <br /> permitted in the district on the date of issuance of the building permit for <br /> the remodeling or rebuilding and must comply fully with the applicable <br /> dimensional requirements; <br /> <br /> (c) EXPANSION PROHIBITED. Unless permitted by Section 40-53.4, no building <br /> or structure containing a nonconforming use may be expanded, nor shall a <br /> new building or structure be erected on a zone lot containing a <br /> non-conforming use, except that such expansion or erection shall be allowed <br /> if the building or structure or portion thereof created by the expansion or <br /> construction is Used only for purposes conforming fully with the uses <br /> allowed in the zoning district on the date of issuance of the building permit <br /> for such expansion or construction, and that the area expanded or erected <br /> complies fully with the applicable dimensional requirements; <br /> <br /> (d) RECONSTRUCTION. Any nonconforming building or any building containing <br /> a nonconforming use, which has been damaged by fire or other causes, may <br /> be reconstructed and used as before if it be done within one year of such <br /> damage, unless such buildLng or structure has been declared by the <br /> building official to have been damaged to an extent exceeding sixty (60) <br /> <br />121 <br /> <br /> <br />
