6. That Section 30-241(c) of the Code of the City of Portsmouth, Virginia, 1988, be amended to read as follows: Section 30-241. Service-connected disability retirement allowance. (c) The compensation finally awarded to the member under the Virginia Workers' Compensation Act or adjusted pursuant to that act shall be deducted from any allowance becoming payable under the provisions of this section, and the excess of the allowance, if any, shall be paid to the member. When the time for payments of compensation under such act has elapsed, the member shall thereafter receive the full amount of such allowance payable at least monthly during his lifetime and continued disability. 7. That Section 30-247 of the Code of the City of Portsmouth, Virginia, 1988, be amended by amending subsection (a)(1) and enacting subsection (d) to read as follows: Section 30-247. Optional benefits. (a) Each member who retires under any of the ~rovisions of this article shall have the right at any time, not subsequent to the later of the effective date of the member's retirement or the date of the written notification to the board of the retirement of the member, to elect to have his retirement allowance payable under any one (1) of the options set forth in this section in lieu of the retirement allowance that would otherwise be payable to him. The amount of such optional retirement allowance shall be the actuarial equivalent of the amount of the retirement allowance that would otherwise be payable to him. The member shall make any such election by written request to the board and such election shall be subject to tSe ~p~oVal of the board. (1) Joint and last survivor option. The member shall be provided a fifty percent (50%) spousal option at ho cost to the member calculated on a spousal age difference of no younger than five (5) years of the member. If the spouse is more than five (5) years younger than the member, the member may elect to receive a decreased retirement allowance during his lifetime which represents the additional cost for a member's spouse who is younger than five (5) years of the member. The member may also elect to receive a decreased allowance during his lifetime based on the additional cost of a 75% or 100% spousal option. If the member's retirement is for disability, the retirement allowance to be continued after the member's death shall be limited to a maximum of one-half of the retirement allowance received by the member during his lifetime.
