That Section 30-241(c) of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended to read as follows: <br /> <br />Section 30-241. <br /> <br />Service-connected disability retirement <br />allowance. <br /> <br /> (c) The compensation finally awarded to the member under <br />the Virginia Workers' Compensation Act or adjusted pursuant to <br />that act shall be deducted from any allowance becoming payable <br />under the provisions of this section, and the excess of the <br />allowance, if any, shall be paid to the member. When the time <br />for payments of compensation under such act has elapsed, the <br />member shall thereafter receive the full amount of such <br />allowance payable at least monthly during his lifetime and <br />continued disability. <br /> <br /> 7. That Section 30-247 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended by amending subsection <br />(a)(1) and enacting subsection (d) to read as follows: <br /> <br />Section 30-247. Optional benefits. <br /> <br /> (a) Each member who retires under any of the ~rovisions <br />of this article shall have the right at any time, not <br />subsequent to the later of the effective date of the member's <br />retirement or the date of the written notification to the <br />board of the retirement of the member, to elect to have his <br />retirement allowance payable under any one (1) of the options <br />set forth in this section in lieu of the retirement allowance <br />that would otherwise be payable to him. The amount of such <br />optional retirement allowance shall be the actuarial <br />equivalent of the amount of the retirement allowance that <br />would otherwise be payable to him. The member shall make any <br />such election by written request to the board and such <br />election shall be subject to tSe ~p~oVal of the board. <br /> <br />(1) <br /> <br />Joint and last survivor option. The member shall be <br />provided a fifty percent (50%) spousal option at ho <br />cost to the member calculated on a spousal age <br />difference of no younger than five (5) years of the <br />member. If the spouse is more than five (5) years <br />younger than the member, the member may elect to <br />receive a decreased retirement allowance during his <br />lifetime which represents the additional cost for a <br />member's spouse who is younger than five (5) years <br />of the member. The member may also elect to receive <br />a decreased allowance during his lifetime based on <br />the additional cost of a 75% or 100% spousal option. <br />If the member's retirement is for disability, the <br />retirement allowance to be continued after the <br />member's death shall be limited to a maximum of <br />one-half of the retirement allowance received by the <br />member during his lifetime. <br /> <br /> <br />
