change. <br /> <br /> 4. That Section 30-237 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended by amending subsections <br />(a) and (b), and enacting subsection (f) to read as follows: <br /> <br />Section 30-237. Service retirement allowance. <br /> <br /> (a) Upon retirement as provided in subsection (a) or <br />subsection (b) of Section 30-236, a member shall receive an <br />annual retirement allowance, payable at least monthly to him <br />during his lifetime, in an amount equal to two and one-half <br />percent (2 1/2%) of his average final compensation multiplied <br />by the first twenty (20) years of creditable service and one <br />and one-half percent (1 1/2%) multiplied by each additional <br />year of creditable service thereafter. <br /> <br /> (b) In addition to the allowance payable under <br />subsection (a) of this Section, a member shall receive an <br />additional allowance equal to monthly payments of one hundred <br />dollars ($100.00) from date of retirement until his <br />sixty-second birthday. This subsection shall not apply to <br />Sections 30-239, 30-241, 30-243, 30-244, 30-245, and 30-246 of <br />this code. <br /> <br /> (f) Any member retiring under the provisions of this <br />section on or after July 1, 1992, and whose creditable service <br />exceeds forty (40) years as of July 1, 1992 shall receive a <br />benefit calculated on two percent (2%) for each year of <br />creditable service multiplied by the member's average final <br />compensation. <br /> <br /> 5. That Section 30-239(a), (b)(4) of the Code of the <br />City of Portsmouth, Virginia, 1988, be amended to read as <br />follows: <br /> <br />Section 30-239. <br /> <br />Ordinary disability retirement allowance. <br /> <br /> (a) Upon retirement as provided in Section 30-238, a <br />member shall receive an annual retirement allowance, payable <br />at least monthly to him during his lifetime and continued <br />disability, in an amount equal to two and one-half percent <br />(2 1/2%) of his average final compensation multiplied by the <br />number of year§ of his "disability credited service," as <br />hereinafter defined. <br /> <br /> (b)(4) Twenty (20) years; if the member's actual creditable <br /> service is greater than twenty (20) years, <br /> "disability credited service" shall be equal to the <br /> member's actual creditable service. An allowance <br /> shall be payable to the member according to <br /> subsection (a) of this section and an additional one <br /> and one-half percent (1 1/2%) for each year of <br /> creditable service after twenty (20) years. <br /> <br /> <br />
