1992-7 <br /> <br />AN ORDINANCE CLOSING A PORTION OF BARCLAY AVENUE° <br /> <br /> WHEREAS, Gino's Pizza of Tidewater, Inc. <br />application to vacate, close and discontinue <br />described portion of Barclay Avenue; and <br /> <br /> has made <br />the hereinafter <br /> <br /> WHEREAS, by resolution of this Council adopted September <br />10, 1991, viewers were appointed pursuant to Section 15.1-364, <br />Code of Virginia, 1950, as amended, to view the hereinafter <br />described portion of said street and to report in writing <br />whether in their opinion any, and if any any what, <br />inconvenience would result from discontinuing said portion of <br />Barclay Avenue; and <br /> <br /> WHEREAS, the said viewers have reported in writing that <br />in their opinion no inconvenience would result from the <br />closing and discontinuing of said street. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br />of Portsmouth, Virginia, that the hereinafter described <br />portion of Barclay Avenue be closed and vacated as a public <br />street. <br /> <br />BARCLAY AVENUE <br /> <br /> That portion of Barclay Avenue (formerly Rose <br />Avenue) beginning at a point 130 feet, more or less, <br />northwest from the intersection of Barclay Avenue <br />and George Washington Highway as shown on the plat <br />of Garden Homes recorded in the Clerk's Office of <br />the Circuit Court of the City of Chesapeake, <br />Virginia in Map Book 21 at page 68 and 69; and from <br />thence in a northwesterly direction a distance of 91 <br />feet, more or less, to a point parallel with the <br />western boundary of Parcel 10 as shown on Tax Map <br />464. Said right-of-way being 20 feet in width; <br /> <br /> BE IT FURTHER ORDAINED that the City of Portsmouth hereby <br />reserves unto itself a perpetual easement, right and privilege <br />to install, operate, maintain and replace sewer mains, sewer <br />drains, sanitary sewers, storm drains, and/or drainage <br />ditches, over, under and across the hereinabove described <br />portion of Barclay Avenue. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held January 28, 1992. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
