1992-7 AN ORDINANCE CLOSING A PORTION OF BARCLAY AVENUE° WHEREAS, Gino's Pizza of Tidewater, Inc. application to vacate, close and discontinue described portion of Barclay Avenue; and has made the hereinafter WHEREAS, by resolution of this Council adopted September 10, 1991, viewers were appointed pursuant to Section 15.1-364, Code of Virginia, 1950, as amended, to view the hereinafter described portion of said street and to report in writing whether in their opinion any, and if any any what, inconvenience would result from discontinuing said portion of Barclay Avenue; and WHEREAS, the said viewers have reported in writing that in their opinion no inconvenience would result from the closing and discontinuing of said street. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that the hereinafter described portion of Barclay Avenue be closed and vacated as a public street. BARCLAY AVENUE That portion of Barclay Avenue (formerly Rose Avenue) beginning at a point 130 feet, more or less, northwest from the intersection of Barclay Avenue and George Washington Highway as shown on the plat of Garden Homes recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia in Map Book 21 at page 68 and 69; and from thence in a northwesterly direction a distance of 91 feet, more or less, to a point parallel with the western boundary of Parcel 10 as shown on Tax Map 464. Said right-of-way being 20 feet in width; BE IT FURTHER ORDAINED that the City of Portsmouth hereby reserves unto itself a perpetual easement, right and privilege to install, operate, maintain and replace sewer mains, sewer drains, sanitary sewers, storm drains, and/or drainage ditches, over, under and across the hereinabove described portion of Barclay Avenue.
