1992-6 <br /> <br />AN ORDINANCE TO AMEND CHAPTER 14 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 14-5(j), <br />14-6(a), 14-10, AND 14-13(a)(1) PERTAINING TO FLOODPLAINS. <br /> <br /> BE tT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Sections 14-5(j), 14-6(a), 14-10, and <br />14-13[a)(1) of the Code of the City of Portsmouth, Virginia, <br />1988, be amended to read as fcllows: <br /> <br />Section 14-5. <br /> <br />Specific definitions. <br /> <br />(j) Historic Structure - Any structure that is: <br /> <br />(1) <br /> <br />Listed individually in the National <br />Register of Historic Places or <br />preliminarily determined by the Secretary <br />of the Interior as meeting the <br />requirements for individual listing on the <br />National Register; <br /> <br />(2) <br /> <br />Certified or preliminarily determined by <br />the Secretary of the Interior as <br />contributing to the historical <br />significance of a registered historic <br />district or a district preliminarily <br />determined by the Secretary to qualify as <br />a registered historic district; <br /> <br />(3) <br /> <br />Individually listed by the Commonwealth of <br />Virginia in an inventory of historic <br />places. <br /> <br />Section 14-6. <br /> <br />Description of district. <br /> <br />(a) Basis of District. <br /> <br /> The floodplain district shall include areas subject to <br />inundation by waters of the one hundred-year flood. The basis <br />for the delineation of the district shall be the one <br />hundred-year flood elevations or profiles contained in the <br />Flood Insurance Study, dated May 2, 1983, and the Flood <br />Insurance Rate Map (FIRM) prepared by the Federal Emergency <br />Management Agency, Federal Insurance Administration, dated <br />November 2, 1983, as amended. <br /> <br />Section 14-10. General provisions. <br /> <br /> (a) Permit Requirement Ail uses and development <br />occurring within the floodplain district shall be undertaken <br />only upon the issuance of a building permit.
