make an immediate investigation for the purpose of <br />ascertaining whether or not the presence of such minor is in <br />violation of any of the provisions of this ordinance. If such <br />investigation reveals the presence of such minor is in <br />violation of any of the provisions of this ordinance, then the <br />officer shall take the name and address of such minor and the <br />name and address of the parent, guardian, or other adult <br />person having the care, custody or control of such minor, and <br />may charge the minor with a violation of this ordinance and <br />release the minor on a summons, or the officer may cause the <br />minor to be taken to his home or ~lace of residence, and <br />released to his parent, guardian or other adult person having <br />the care, custody or control of such minor. If the officer <br />deems that it will be for the best interest of the minor, the <br />minor may be taken to the Intake Division of the Juvenile and <br />Domestic Relations District Court of the city and thereafter <br />be released or detained as provided for in the Code of <br />Virginia. <br /> <br /> (d) If any such minor refuses to give any police or <br />other officer his name and address or the name and address of <br />his parent, guardian or other adult person having the care, <br />custody or control of such minor, such officer shall take such <br />minor to police headquarters and there detain him until such <br />time as he can be turned over to the officers of the Juvenile <br />and Domestic Relations District Court of the city to be dealt <br />with in the manner required by law. <br /> <br /> (e) Any person who violates any of the provisions of <br />subsection (b) of this ordinance shall be guilty of a class 4 <br />misdemeanor. Any minor violating any provision of subsection <br />(a) of this ordinance shall be deemed to be a minor or a child <br />in need of services, and such minor and his parent, guardian, <br />leqal custodian, or other person standing in loco parentis <br />shall be subject to the provisions of Section 16.1-279 of the <br />Code of Virginia or to any related statutes or provisions of <br />the Code of Virginia. <br /> <br /> (f) The provisions of this section shall not apply to <br />any minor who has been emancipated as provided for in the Code <br />of Virginia. <br /> <br /> 2~ That this ordinance shall take effect on the date of <br />its adoption. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held July 28, 1992. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
