1992-66 AN ORDINANCE TO Ab~END CHAPTER 24 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTION 24-8 THEREOF, PERTAINING TO CURFEW FOR MINORS. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Section 24-8 of the Code of the City of Portsmouth, Virginia, 1988, be amended to read as follows: Section 24-8. Curfew for minors. (a) It shall be unlawful for any minor under the age of eighteen years to be and remain in and upon any street, avenue, road, alley, park, playground, or in or upon any other public place in the City or in any vehicle operating or parked thereon, between the hours of twelve midnight and 5:00 a.m. of the following day unless such minor is accompanied by his parent, guardian or other adult person having care, custody or control of such minor or is on an emergency errand or is engaged in a lawful employment or going directly to the place of such lawful employment or returning directly to his place of residence from the place of such lawful employment, or unless such minor has a written statement to that effect signed by his parent, guardian or other adult person having the care, custody or control of such minor, or unless such minor has written permission by the parent, guardian or other adult person having the care, custody or control of such minor to attend a specified engagement or performance which begins prior to midnight and ends either after midnight ok so close to midnight that it is impracticable for ~uch minor to reach his residence prior to twelve midnight and such minor is presen~ at such engagement or performance or is preceding directly to his place of residence upon conclusion thereof. (b) It shall be unlawful for any parent, guardian or other adult person having the care, custody or control of any minor under eighteen years of age to knowingly permit, allow or encourage such minor to be and remain in and upon any street, avenue, road, alley, park, playground, or in and upon any other public place in the City or in any vehicle operating or parked thereon between the hours of twelve midnight and 5:00 a.m. of the following day, in violation of the provisions of subsection (a) of this ordinance. (c) Whenever any police officer or other officer charged with the duty of enforcing the laws of this state or ordinances of this city shall discover or have his attention called to the fact that any minor under eighteen years of age is in or on any street, avenue, road, alley, park, playground, or is in or upon any other public place, or in any vehicle operating or parked thereon, between the hours of twelve midnight and 5:00 a.m. of the following day, the officer shall
