1992-66 <br /> <br />AN ORDINANCE TO Ab~END CHAPTER 24 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTION 24-8 THEREOF, <br />PERTAINING TO CURFEW FOR MINORS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 24-8 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended to read as follows: <br /> <br />Section 24-8. <br /> <br />Curfew for minors. <br /> <br /> (a) It shall be unlawful for any minor under the age of <br />eighteen years to be and remain in and upon any street, <br />avenue, road, alley, park, playground, or in or upon any other <br />public place in the City or in any vehicle operating or parked <br />thereon, between the hours of twelve midnight and 5:00 a.m. of <br />the following day unless such minor is accompanied by his <br />parent, guardian or other adult person having care, custody or <br />control of such minor or is on an emergency errand or <br />is engaged in a lawful employment or going directly to the <br />place of such lawful employment or returning directly to his <br />place of residence from the place of such lawful employment, <br />or unless such minor has a written statement to that effect <br />signed by his parent, guardian or other adult person having <br />the care, custody or control of such minor, or unless such <br />minor has written permission by the parent, guardian or other <br />adult person having the care, custody or control of such minor <br />to attend a specified engagement or performance which begins <br />prior to midnight and ends either after midnight ok so close <br />to midnight that it is impracticable for ~uch minor to reach <br />his residence prior to twelve midnight and such minor is <br />presen~ at such engagement or performance or is preceding <br />directly to his place of residence upon conclusion thereof. <br /> <br /> (b) It shall be unlawful for any parent, guardian or <br />other adult person having the care, custody or control of any <br />minor under eighteen years of age to knowingly permit, allow <br />or encourage such minor to be and remain in and upon any <br />street, avenue, road, alley, park, playground, or in and upon <br />any other public place in the City or in any vehicle operating <br />or parked thereon between the hours of twelve midnight and <br />5:00 a.m. of the following day, in violation of the provisions <br />of subsection (a) of this ordinance. <br /> <br /> (c) Whenever any police officer or other officer charged <br />with the duty of enforcing the laws of this state or <br />ordinances of this city shall discover or have his attention <br />called to the fact that any minor under eighteen years of age <br />is in or on any street, avenue, road, alley, park, playground, <br />or is in or upon any other public place, or in any vehicle <br />operating or parked thereon, between the hours of twelve <br />midnight and 5:00 a.m. of the following day, the officer shall <br /> <br /> <br />
