AN ORDINANCE TO AMEND CHAPTER 35 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 35-12(a) AND 35-500(c) THEREOF, PERTAINING TO TAXATION. BE IT ORDAINED by Virginia: 1. That Section Portsmouth, Virginia, the Council of the~City 35-12(a) of the Code of 1988, be amended to read of Portsmouth, the City of as follows: Section 35-12. Relief from erroneous assessments and erroneous payments generally. (a) Any person who feels that he has been erroneously assessed for real estate tax or local levies on tangible personal property, machinery and tools, or a local license tax, or any other local levy, may, within three years of the last day of the tax year for which assessment was made, or within one year from the date of the assessment, whichever is later, make in writing application to the commissioner of the revenue regarding the assessment of local levies on tangible personal property, machinery or tools, or a local license tax, or any other local levy, or to the city assessor regarding the assessment of real estate, seeking by such application excneration or abatement of such tax if same is unpaid or refund if such tax has been paid. An application that is not timely will not be considered. 2. That Section 35-500(c) of the Code of the City of Portsmouth, Virginia, 1988, be amended to read as follows: Section 35-500. Short-term rental tax. (c) Taxation of rental property that is not daily rental property. Except for daily rental passenger cars, rental property that is not daily rental property shall be classified for taxation pursuant to Section 58.1-3503 of the Code of Virginia. "Daily rental property" means all tangible personal property held for rental and owned by a person engaged in the short-term rental business, except trailers, as defined in Section 46.2-100 of the Code of Virginia and other tangible personal property required to be licensed or registered with the department of motor vehicles, the department of game and inland fisheries or the department of aviation.
