<br />AN ORDINANCE TO AMEND CHAPTER 23 OF THE CODE OF THE CITY OF
<br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 23-4, 23-27(a)
<br />AND (b), 23-30, 23-48(a) AND (b), AND 23-50(b) THEREOF,
<br />PERTAINING TO NUISANCES.
<br />
<br /> BE IT ORDAINED by the Council of th~.City of Portsmouth,
<br />Virginia:
<br />
<br /> 1. That Section 23-4 of the Code of the City of
<br />Portsmouth, Virginia, 1988, be amended to read as follows:
<br />
<br />Section 23-4.
<br />
<br />Lien for abatement expenses incurred by
<br />City - generally.
<br />
<br /> There shall be a lien on any real estate for the amount of
<br />expense incurred by the City in abating any nuisance thereon
<br />after notice to the owner and lien holder thereof by publication
<br />or otherwise as provided by ordinance. Such lien shall rank on
<br />a parity with liens for unpaid local taxes. Such lien shall not
<br />be good against the purchase of such real estate for value
<br />without notice until the lien is docketed as required by Section
<br />23-5.

<br /> 2. That Section 23-27(a) and (b) of the Code of the City
<br />of Portsmouth, Virginia, 1988, be amended to read as follows:
<br />
<br />Section 23-27. Notice to abate-required; contents.
<br />
<br /> (a) Whenever the director finds that weeds exist on any
<br />land, alley, sidewalk or street, he shall give notice in writing
<br />of the existence of the nuisance to the owner or occupant, or
<br />both, and lien holder, of the land on which the nuisance exists,
<br />or to the owner or occupant, or both, and lien holder, of the
<br />land abutting the alley, sidewalk or street on which a nuisance
<br />exists, and shall order the owner or occupant, or both, to cut
<br />and, when necessary, remove the weeds within such reasonable
<br />time as the director shall specify in the notice; provided, that
<br />in no event shall a time allowed be greater than fifteen (15)
<br />days.

<br /> (b) Whenever the director finds that debris exists on any
<br />land, alley, sidewalk or street, he shall give notice in writing
<br />of the existence of the nuisance to the owner or occupant, or
<br />both, and lien holder, of the land on which the nuisance exists,
<br />or to the owner or occupant, or both, and lien holder, of the
<br />land abutting the alley, sidewalk or street on which the
<br />nuisance exists, and shall order the owner or occupant, or both,
<br />to remove the debris within such reasonable time as the director
<br />shall specify in the notice.

<br /> 3. That Section 23-30 of the Code of the City of
<br />Portsmouth, Virginia, 1988, be amended to read as follows:
