AN ORDINANCE TO AMEND CHAPTER 24 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 24-67, 24-68, <br />24-75(a) AND (c), 24-131, AND 24-132 AND BY REPEALING SECTION <br />24-81 THEREOF, PERTAINING TO WEAPONS AND GAMBLING OFFENSES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Sections 24-67, 24-68, 24-75(a) and (c), and <br />24-132 of the Code of the City of Portsmouth, Virginia, 1988, <br />be amended to read as follows: <br /> <br />Section 24-67. <br /> <br />Permit to purchase pistol or like <br />weapon from dealer. <br /> <br /> (a) Before any person purchases or otherwise acquires <br />from a dealer any pistol or any weapon of a like kind he shall <br />obtain a permit therefor from the chief of police. <br /> <br /> (b) Whenever the applicant for a permit to purchase or <br />otherwise acquire a pistol or any weapon of a like kind <br />produces a certified order of the judge of the circuit court <br />authorizing the applicant to carry the subject weapon as a <br />concealed weapon, the chief of police shall issue such permit. <br />In cases where the subject weapon is not to be carried as a <br />concealed weapon, the chief of police shall issue the permit <br />to purchase or otherwise acquire the same subject to the <br />following regulations: <br /> <br />(1) The applicant shall personally sign and complete <br /> written application for the permit. <br /> <br />(2) The applicant shall be fingerprinted by the police <br /> department. <br /> <br />(3) <br /> <br />A report of the police records of the applicant <br />shall be obtained by.the police department from <br />state central criminal records exchange. <br /> <br />the <br /> <br />(4) The applicant shall show a lawful use for the <br /> subject weapon. <br /> <br />When such investigation discloses that the public welfare will <br />be prejudiced by permitting a person of known mental <br />instability or criminal activity involving breach of the peace <br />to acquire such weapon the permit shall not be granted. <br /> <br /> (c) Upon the sale or transfer of any pistol or any <br />weapon of a like kind, the dealer shall secure from the <br />purchaser or transferee the permit to purchase or acquire the <br />same and shall forward such permit with appropriate notation <br />of the sale to the chief of police by personal delivery or by <br />letter postmarked not later than 11:00 a.m. of the second day <br />following such sale. <br /> <br /> <br />
