AN ORDINANCE TO AMEND CHAPTER 24 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 24-67, 24-68, 24-75(a) AND (c), 24-131, AND 24-132 AND BY REPEALING SECTION 24-81 THEREOF, PERTAINING TO WEAPONS AND GAMBLING OFFENSES. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Sections 24-67, 24-68, 24-75(a) and (c), and 24-132 of the Code of the City of Portsmouth, Virginia, 1988, be amended to read as follows: Section 24-67. Permit to purchase pistol or like weapon from dealer. (a) Before any person purchases or otherwise acquires from a dealer any pistol or any weapon of a like kind he shall obtain a permit therefor from the chief of police. (b) Whenever the applicant for a permit to purchase or otherwise acquire a pistol or any weapon of a like kind produces a certified order of the judge of the circuit court authorizing the applicant to carry the subject weapon as a concealed weapon, the chief of police shall issue such permit. In cases where the subject weapon is not to be carried as a concealed weapon, the chief of police shall issue the permit to purchase or otherwise acquire the same subject to the following regulations: (1) The applicant shall personally sign and complete written application for the permit. (2) The applicant shall be fingerprinted by the police department. (3) A report of the police records of the applicant shall be obtained by.the police department from state central criminal records exchange. the (4) The applicant shall show a lawful use for the subject weapon. When such investigation discloses that the public welfare will be prejudiced by permitting a person of known mental instability or criminal activity involving breach of the peace to acquire such weapon the permit shall not be granted. (c) Upon the sale or transfer of any pistol or any weapon of a like kind, the dealer shall secure from the purchaser or transferee the permit to purchase or acquire the same and shall forward such permit with appropriate notation of the sale to the chief of police by personal delivery or by letter postmarked not later than 11:00 a.m. of the second day following such sale.
