43 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN <br />EASEMENT AGREEMENT WITH VIRGINIA POWER ON CITY-0WNED PROPERTY <br />AT LAKE KILBY, SUFFOLK, VIRGINIA. <br /> <br /> WHEREAS, Virginia <br />facilities in the area <br />and <br /> <br />Power is currently upgrading its <br />of Lake Kilby in the City of Suffolk; <br /> <br /> WHEREAS, Virginia Power desires to remove the industrial <br />substation which now serves the facilities of the Public <br />Utilities Department, as it is no longer needed, and contains <br />hazardous materials, and <br /> <br /> WHEREAS, the removal of this facility requires additional <br />easement for underground cable; and <br /> <br /> ~EREAS, the Council of the City of Portsmouth, Virginia, <br />deems it to be in the best interest of the City to grant said <br />easement. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Manager be, and he <br />hereby is, authorized to sign an easement agreement with <br />Virginia Power for property located at Lake Kilby in the City <br />of Suffolk, Virginia, as shown on Virginia Power plat number <br />26-92-0022. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he <br />hereby is, authorized to sign such documents as may be <br />necessary to carry out the intent of this resolution. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held on May 12, 1992. <br /> <br /> Teste: <br /> <br />City Clerk <br /> <br /> <br />
